My father met with an accident and was in coma for 3yrs,in dec,2008 he passed away with no will. We were always a nuclear family (2 daughters) & got no support from my dad's family. my mother had applied for a successon certificate but the court also wants my grandmother to testify, but she would put an objection. she is financialy independant and owns a house in U.P.
Please advise if there is a way to contest the court's decision regarding my grandmother's NOC.

Succession certificate was applied for what?u r grandmother is legal heir along with u,u r sister and u r mother.she is a necessary party to the succession case.

Grandmother is entitled to inherit the share from the property left by your father whether she contributed in constructing it or not. So she is a necessary party to be impleaded in the case but she (grandmother) can oppose about her share and cannot object succession certificate in respect of all other legal heirs of your father who are ready to provide it in favour of your mother.

your grandmother is also legal heir of your father.
