Dear Sir,
Mere Shadi ko 2 saal ho gaye, Aur humain 1 beta hai. Now my wife wants divorce but i can' not leave my child. He is just 1 years old. Can I get my child forever after divorce. Kindly suggest me on frzahd.firoz@gmail.com
But maine suna hai ki as per Muslim Law baccha 2 saal tak apne maa ke paas rahega uske baad apne baap ke paas. Is it right? please explain in view of Muslim law...!

Dear Mr.Firoz,
Child custody depends on a lot of factors without going into which nothing can be said. But remember that welfare of child is of paramount consideration, and whoever's custody is conducive for child's overall mental/physcial/economical/emotional needs - would be preferred. The Mother is preferred ordinarily for child below 5, but this is no hard and fast rule.
Consult a local advocate.

Rightly adviced by the experts.Even after divorce you cannot expect the custody of the child till he completes 5 years.But after such a gap,mentally he will be more attached to the mother,and he may be reluctant to come to you.

The child custody would be decided on the sole basis of welfare of the child.
However 1 year child the court would weigh heavily in favor of mother.
