Respected experts,I needed case law to show a purchaser of tiles for the purpose of laying down in hospital is a 'consumer' according to Consumer Protection Act?

Sir, in a consumer case where our client bought tiles for his lodge, were found defective. He had filed a suit against the manufacturer. The court has held he is not a consumer as the tiles are used for commercial purpose. We need to show he is a 'consumer' as they are not used for commercial purpose like selling them to consumers as in the case of builders of construction etc.

convince the court (Appeal) that the tiles purchased or not for sale but for use in the own building. At any stretch of imagination, tiles purchased for final use(Consumption) can not be termed commercial.
suppose u purchase a Tyre for your car which is used as taxi, then is your purchase for commercial purpose?
