Querist : Anonymous (Querist) 18 September 2010 This query is : Resolved
When natural parents of child consent to adoption and an adoption deed is registered and all parties qualify for adoption under Hindu Adoption act, is court approval a must for adoption to be valid?
Adv Archana Deshmukh (Expert) 18 September 2010
No.
Raj Kumar Makkad (Expert) 18 September 2010
If the parties to the adoption are well qualified for the adoption and due adoption has been made and the same has been got registered with registrar then their is no need to get approval of the court and such adoption is treated as legal and valid untill and unless some contrary fact is not placed.
Devajyoti Barman (Expert) 19 September 2010
No but actual taking and giving the child must happen accompanied by a ritual.
