ENQUIRY ABOUT POWER OF NGO

Querist : Anonymous (Querist) 06 March 2011 This query is : Resolved
In August 2010, my wife went to live with her mother for sixth or seventh time in twelve years of married life.

After one week, I went with my parents and relatives to her mother and brought back my wife and 10 years old daughter.

I came to know that in that one week, one of my SAALI (sister in law) took my wife to an NGO and gave written complaint against me .

I had said sorry to all in house of my mother in law when I went to take my wife and daughter back.

But, seven months have passed. Three councelling sessions have been done at NGO office FOR me and my wife . Last session was before DIWALI in 2010.

They are sympathetic towards me and angry by attitude of my wife ( MY WIFE HAS SIX SISTERS AND THREE BROTHERS).ALL OF THEM INTERFERE IN MY MARRIED LIFE BUT DO NOT ADMIT IT but it is an open fact to whole society.

On first councelling session in NGO, Me and my parents signed on the draft paper made by NGO, but my saali ordered my wife not to sign.
My wife did not sign saying her once divorced, now secondly married DIDI has read draft agreement . It says husband will not do this and wife won't do that in future.

She concluded that signing that paper will mean that in past she was doing those wrong things.

Case is still open before NGO for domestic violence.

NGO staff appreciates me on each councelling session for not beating my wife.

Then they start giving lecture to my wife for one or two hours. They have told me that if I tell minus points of my wife, dispute will increase. So they ask me to sit silently and make my wife feel ashamed by giving lot of lectures. My wife does not like them any more and does not dare to contact them anymore.

BUT THE CASE IS STILL OPEN IN NGO.

They did not give any complaint copy or any paper, just said that when dispute will be finished, they will give every thing to us which will make us feel ashamed.

For how much time can the case be kept open by NGO ? They are of opinion that husband is like female nature and wife is like male nature .

Some of the NGO's are in State panel appointed to act as protection officer (PO) for Domestic Violence Cases under PWADV Act 2005. They have been authorised to prepare a DIR (domestic incidence report) and are also empowered to do counseling in the ambit of said act.

2. NGO are covered under RTI Act. You may seek first an information under RTI Act how many pages in such and such case file of parties name. Once reply received you may seek true copy of entire file to study the same and or to use for consultation with an appointed Ld. Advocate in future.

3. The case before NGO needs to be followed regularly as wife may convert it into a complaint case under DV Act and may seek various relief’s’ if all counseling efforts fails between parties.

4. Seek help of a ld. Advocate to guide you on day-today basis in presented briefs situation.

Respected Sir,
Thank you vey much for your reply.
But you did not answer that "FOR HOW LONG TIME PERIOD CAN THE NGO KEEP THE CASE OPEN "

NGO has not bothered to enquire about my case for last several months.

What I pray to GOD is that case should be closed by NGO and they must mention in it that husband and his parents signed but wife was ordered by her sister not to sign and she did not sign on the draft agreement.

If I go to some advocate, and my wife came to know about it, her SIX sisters and THREE brothers will think that I am planning litigation for divorce , which is not true.

My parents are old enough and I do not want any more tension for them.
Please guide me.
