If a client engages an Advocate, he does it by executing Vakalatnama.

If an Advocate is already conducting a case; and he wants to appoint another Advocate along with him, by what instrument or writing he can make such appoinment?
Adv.Shine Thomas (Expert) 10 September 2008
He wants to file a Joint Vakalathnama.
Srinivas.B.S.S.T (Expert) 10 September 2008
a fresh vakalatnama with an endorsement no objection to appear along with, and the same should be accepted by the another acvocate along with whom he wants to conduct the case.
KamalNayanSaxena (Expert) 10 September 2008
Memo of appearance by counsel would be sufficient.
Rajesh Kumar (Expert) 10 September 2008
I dont think any wakalatnama is required, if he is present.
When the advocates engages a senior counsel, no wakaltnama is filed, as per law.

RAKHI BUDHIRAJA ADVOCATE (Expert) 10 September 2008

Sirs, I am very grateful that all of you have quickly responded to my query. But my query is whether the Advocate can engage another advocate without obtaining the consent of the client. Would it be technically right?
KamalNayanSaxena (Expert) 12 September 2008
There is inherant in the position of counsel an implicit authority to do all that is expedient, proper and necessary for the conduct of the suit ubject undoubtedly to two overriding considerations : (i) He must act in good faith and for the benefit of his client (ii) It is prudent and proper to consult his client and take his consent if there is time and opportunity.
Vijay Kumar (Querist) 12 September 2008
Thanks Mr. Saxena.Kindly tell by which mode a counsel can make appointment of an other counsel? By executing Vakalatnama in the favour of new counsel or some other mode?
KamalNayanSaxena (Expert) 12 September 2008
As answered above.
