Dear Sir,
Is there any case study which proves eligibility to sale DEPB Licence sale against Form C in Gujarat. The Accessing authority is in viwe that DEPB Licence cant be sold against form C..

Please tell who is currently holding the DEPB licence and where is the physical DEPB is lying.
Please also tell the State in which the agreement of sale of the DEPB is being executed.
In case the DEPB is residing in the same state in which the Agreement is also being executed, but the buyer is in another State, in that case, please indicate how the DEPB will be given to the Buyer.
Only on getting / knowing the above information, it will be possible to provide an answer to your query.

Once DEPB comes under the definition of goods as per the decision of Apex Court and liable to tax under the Local Act as well as under the CST Act, then there is no bar to sale the DEPB under the CST Act.
