drafting deed of conveyance

(Querist) 21 September 2010 This query is : Resolved
Hi,
While drafting deed of conveyance,is it necessary to mention all the transaction made for that particular prpoerty or good title of previous owner is sufficient
adv. rajeev ( rajoo ) (Expert) 21 September 2010
good tittle of the previous owner is sufficient.
Y V Vishweshwar Rao (Expert) 21 September 2010
It is always better to mention the History of Title with Reference to Registered Transactions/Deeds on the property
Chanchal Nag Chowdhury (Expert) 21 September 2010
I fully agree with Mr.Rao.However, if the History of Title with Reference is not available,U have no alternative but to state the good title of previous owner.
It is curious as to how the previous owner had a good title without a History, except possibly, in the case of intestate succession.
Devajyoti Barman (Expert) 21 September 2010
Yes, the chain of title is always prudent to mention .
Sri Vijayan.A (Expert) 21 September 2010
It is good to start from the root document. This is the general rule.
What is root document is the question now.
The document issued by Government, or the title deeds with the history of atleast 30 years may be taken as parent documents.
There is no hard and fast rule for making the recital.
B.Chakrapani Warrier (Expert) 21 September 2010
Full history of the title should be mentioned in the preamble and in the "schedule of property" of the sale deed.
