Doubt on ancestral property

Respected Sir,
We are having property which came from our Grandfathers,My father and his Elder brother,but my dads brother had expired at young age,he is having a daughter i.e our cousin sister,my dad is army person,Dad used to look our crops n lands whenever he get leave,after my grand mother ,Dad is the owner by revenue records which came by D.K Patta,whenever dad requested his sister inlaw (Bhabhi) to come and divide the property,she had denied my dads idea,my dad expired in 2003,Till now We had given 50% share in everything to them.
We r paying Revenue tax ,in January month when my mom went to village,their the Locals and even in Register office some persons had told to mom that entire records is on ur family name,Why dont u do register these on your sons name,because your daughter(dads brother daughter)is trying to convert Property on her name,our Original Passbook which is on my dads name was with my Sister.
My Mom then took EC for last 100yr,in that records everything is on my family name,after grand mom name,Dads name,after my Dads death,records came on my Moms name,In records there is no name of my father inlaw(dads brother)nor mother in law.My mom had Given Gift Deed to me and my Brother.Now latest original records are with us.
My Sister is luxoury type women,they dont even cook all frm hotel,they r completely dependent on our property,and moreover we dont know much about crops n lands,she knows more.
Sister is calling to me and saying,that she will send notice to us shortly,if she really goes to court,can she win on us ?
They dont have any records on their name,every tax receipt is on my dads name,after tht moms name.
Please tell me that can my sister win on us

when it is property of your grand father. your father, his brothers and his sisters are equal rights in those properties.

All heirs has equal right.
If u get notice, reply accordingly.
Court will decide on equality.

As per your version that property is from your grand father so all are equal share those who are the son and daughter of ur grand parents. So give the share to ur sister and other share. Should be divided to ur brother and if sister

Dear Sekhar,
That is ancestral property,all the legal heirs have equal share irrespective of the gender.It is immaterial whether your father had cultivated the lands or some other person.When it comes to sharing everyone will have an equal share.
