Does digital photographs count as valid proof in court?

(Querist) 11 June 2014 This query is : Resolved
The plaintiff owner of building has filed a bonafied case on me tenant and asks for evac.

I have various proofs like voting card, ration, electric bill etc.
But in his last application he mentioned that i am not residing at suit premises.
Can i give 4-5 photos taken from mobile , take its print (with dates on print) and submit it to court? This photos clearly shows i am in the suite premises.

Is a digital photo print considered as valid proof ? My lawyer is saying it wont get much value, so wanted to have a second opinion of the same.

Thank you.

who are you and how are related to this query?
Advocate. Arunagiri (Expert) 12 June 2014
It is not necessary that you should be within the premises. You have to submit a proof that you are using the premises.

When the suit it self confirms you are in possession and supported by other documents like ration card etc photos not required. If at all you have done any repairs in the premises like plumbing, attendind water leakage renovation , interior works etc such photos would have some value.

Agree with the expert.

Even if you want to submit photographs, you should get it snapped from some commercial photographer submit these along with his payment receipt and his evidence in person.

Mr./Ms.Niky....
First reply to the clarification sought by expert Shri Barman ji.
By looking into your profile and the other queries posed by you, the problem is not related to you. If you really require assistance of the experts, you should come with full facts.
The owner filed a bonafide case on me...
If the case is bonafide, why are you resisting? Give possession back to the owner.

Photographs to be proved by examining the photographer on Affidavit + cross examn.
Biswanath Roy (Expert) 12 June 2014
If direct evidence of your residency cannot be proved or doubtful you can submit circumstantial evidences also like Affidavit by the next door neighbour.

I am the Defendant. And my photos are not by any professional but taken by my family members on our camera. So i need not worry much about the photo proofs, will go as per your suggestion.

Thank you very much respected experts for your suggestions/advise.
T. Kalaiselvan, Advocate (Expert) 14 June 2014
The advise rendered by expert Mr. Rajkumar appears to be more suitable, try that, photograph cannot be fully relied upon for various reasons.
