(Querist) 13 January 2018 This query is : Resolved
I have filed contested divorce against my husband in November 2016. Now my case is in regional court. The court giving chances to my husband to file a counter against me from February 2017. Till now he has not filed a counter petition in the court. And most of the timings judge is not coming to the court. Due to judge not available the dates are postponing most of the timings. Can any one suggest me to speed up the process. Will the court gives these many chances to file counter almost an year. Please let me know what should I have to do in order to speed up the process.

Such situations often happen! By the way, what is regional court?

You may address a letter to the Hon. High Court of your State stating the details.

Does your own lawyer incapable of doing anything in that respect? The case can move ahead only if your lawyer takes interest. Otherwise, let it go at its own pace.

Divorce case and claiming maintenance is two different .Irrespective of Divorce Case Pending the Interim Maintenance would be Ordered. Your Advocate is leading you in the Right Path so do not be in hurry and do not doubt your Advocate.Just Follow his Advise and Guidance and be Patience..

The querist has not raised any question about claiming maintenance or even interim maintenance, as assumed by the expert Mr. N.J.S. Rajkumar. Her query was limited up to divorce. Even interim maintenance case would not have been expected to go beyond January 2017.

" Some Times the First Step to Forgiveness is understanding that the Other Person is Complete Idiot "- English Quote.

1) Any Practicing Advocate would agree and understand that Divorce cases will not be completed in short time except it is Mutual Consent Divorce. We could find the Divorce Cases Pending even for more than 10 years in Family Courts.

2) In the Last Post the author had clearly Stated that their Advocate is in process of filing the Maintenance Petition.Which is a very good and wise decision of their Advocate which has to be Welcomed and appreciated.

Irrespective of the Divorce Case Pending the Court would certainly order for Interim Maintenance which the Practicing Advocates would agree and understand.
Guest (Expert) 21 January 2018
The Author had referred to Regional Magistrate Courts as Regional Courts.

The learned expert should know that court cases are not move merely by making English quotes. Cases move by taking initiative by the lawyer of the case. By the way, whose fault is this if the concerned advocate had been sleeping for over 14 months even in maintenance case? Knowing very well that contested divorce case takes a lot of time, he could have taken initiative to file maintenance case to get interim maintenance even within 60 days.

What English quote the learned expert would prefer to make for such lethargic move by his favoured advocate?
