Dispute Family as well as property,

(Querist) 01 September 2009 This query is : Resolved
I purchased a house in 2006, where i am the sole owner and my dad and brother supported as co-applicant. i got married in 2007 and my wife is not accepted by my parents there was no beating or violence but my mother, father and brother both have mentally harassed her a lot. keeping that in mind i moved out of my house on loan along with my wife. but they are still staying in the same house and forcibly paying the installments directly to the bank for the loan, as i wanted to release the property i stopped the loan repayment so that they move out of the house. They are hellbent on not leaving my house and now forcing me to sign a gift of deed and hand over the property to my father. i am not ready to do that. Also they have always been threatening my wife that she has no ownership in the house and its my fathers property so on and so forth. because they supported me or stood security for me. Please help cause i dont want to lose my house nor do i want to hurt my wife and parents. But they are such stubborn that they are not ready for any compromise either.

It is a family dispute, seeking legal remedy will worsen the relations, hence advise to seek help of community elders and settle the issue amicably, even then they don't fall in track, then only remedy will be seeking judicial intervention.

Hi can you help me find the community elders, as i am not sure whom to contact.
R.R. KRISHNAA (Expert) 01 September 2009
Since your dad and brother are co applicants how can you call yourself a sole owner.

A. A. JOSE (Expert) 01 September 2009
Mr.Shama,

Your story is full of contradictions . If the loan is on your name, how can your parents/brother repay the amount ? Further, as has been rightly observed by Mr.Krishna when your Dad and brother are coapplicants, how is it that you claimed to be sole applicant. Since, it is rather a family fued, Mr.Vishal has rightly opined you to find some amicable way to resove the issues. After all, is it not your own Dad, mother and brother on the other side which fact cannot be glossed over. It is for you to ponder over who can be the elders or community leaders to mediate in the matter and none else can decide the same .

i agree with Mr. Vishal and Mr. Jose.

hey guys thanks to all. But these are the details that i have received in writing from the bank. they say co-applicant cannot always be an owner. but the co-owner / co-borrower has to compulsorily be the co-applicant. In my case the two co-applicants are neither co-owners nor co-borrowers.
But bank is also not willing to transfer the loan to either of them. The bank says once the loan is completely repaid no matter what, I am the single owner of the property.
