Regional head saying that he will suspend me

(Querist) 17 August 2017 This query is : Resolved 
Sir,I am working as Field executive in a Central government office for the last 5 years.From July 2017,I was allotted a NEW field work, which I had no experience of doing earlier.My supervisor found some mistake at the time of inspection and reported to Regional Head, who took it very seriously and talked to my Office in charge that he is going to suspend me.Kindly reply what i should do.

Try to meet the Office In Charge, Regional Head and explain and request not to exercise penalty of such magnitude........

Better your rapport, goodwill with supervisor to mind your own interest in future...........

You may also download and obtain copies of service rules, conduct and discipline rules, and relate the error and penalty for such error.............in the rules.........

Learn the new assignment from seniors..................

Rather get first hand feel before you start new assignment, from seniors............

Legally, there is no check on issuing suspension orders on you if issued by proper authority. Due procedure has to be followed. If such thing happens, immediately engage some experienced defense representative from your institution and defend yourself in the inquiry.

Which is the central (Union) government department has employed you designated as "field executive" having supervisor and regional head?
After 5 years of service your job is already confirmed i.e., successfully completed probation period, isn't it?
If there is some iota of truth in the query, Article 310 and 311 of the Constitution of India, 1950 is applicable in your case, in that eventuality you should consult a local lawyer practicing service matters, otherwise, it is a pure fabricated and unbelievable story.

You have not mentioned, what was the mistake on which the office in-charge proposes to suspend you. For making suspension, no preparations are required. So, if decided to suspend you, what makes him wait to suspend you?

If not suspended yet, where lies any problem for you and what help exactly you want from the members? Please remember, neither any member of this forum can exert any influence on your disciplinary authority nor even the court can order him not to suspend you, if you made any grave irregularity.

Appear before Supervisor, Office in Charge, and Regional Head and explain and write under proper acknowledgment.

Have you downloaded the rules and gone thru these and related your matter...............!
Do you have on record that said codes were to be issued to you and were not issued to you and have pursued for these?


If the said codes were not issued you could have requested to supply so that you can submit said report?

The office in charge may ask or might have asked for your version/explanation.

Tender carefully.

Try to escape by your skills, goodwill, rapport, request, appeal...........

You have to be issued a warning citing lapse before suspending and you can respond for the same in terms of your responsibility and reality. Better learn the job and perform as expected under rules with good rappo with your seniors.

Employee in such matters should start to prepare defense and arrange for a seasoned defense assistant and a very able counsel as already suggested.

Handling work and bosses is a skill that can be acquired and should be acquired.

it clearly indicates that your follies are serious as it was reported to RD and who feels like suspending you.

whenever there is a query from any govt servant you advise him to download service rules.

first of all service rules applicable to central govt are also available in market at select designated shops.

secondly if he was able to download the rules and also understand the same the person would not have been here.

thirdly as far as this queriest is concerned you may refer to his other posts. he needs to be advised to be amenable to discipline and do his job properly and stop instigating superiors. Following advise likr "down load rules' "meet counsel" "you cannot be suspended" etc is suicidal for persons.

In his other post I have advised him that as per rules he can be called upon to do any work for any number of hours on any day etc. I purposely did not disclose the rule behind such power of govt as employer
