cross examination ?

Hi Experts,

I need advice that our opponent party husband of my client file divorce petition & now on evidence stage,they tender their affidavits,we cross them on next date,we have panchyatenama in which petitioner admitted his 2nd marriage,one another document in which his 2nd wife name appear.my query is when petitioner evidence are not closed,how can we exhibit these documents during cross to petitioner & other witnesses.plz reply me soon.it is very urgent.

You can show that document at the time of cross examination. If he admits then it is admissible and exhibited. If refuses then you have to summon the concerned official for formal proof of that document.

Those documents are in original with the Panchayat.So even if you get true zerox copies of those documents they cannot be exhibited,however you can ask questions about those documents and then show them during cross examination and if he admits his signature,the court may be requested to exhibit the documents,but if not in that case you will have to examine the Panchayat witness with original record and get those documents exhibited.

yes, you can confront the witness by those documents. in case denied their existence. you can summon the same.

Under order 8 rule 2 file and application and seek permission of the court to be taken on rcord by giving the reason u may file the documents in the court and the court may consider it.
