Credit card fraud

Hi,

My ex-husband has used Credit card of my name and has not paid any amount. Now the card is in defaulters. I have proofs of him saying that he will pay all dues in sms. But he has not done and when now i asked him to do the needful and he denies. Bank is chasing me for payment. He had done all transactions on petrol which i believe bank will e having. Pls could you advice me if there is any law which will help me to get this clear from him. PLS HELP.

you can proceed for action in civil and criminal court subject to law of limitation.

if your husband has used your credit card who has signed transaction slip . if you have not signed transaction slips your husband has forged your signature . lodge a police complaint mentioning detailed facts of the case along with sms received by you .

the card was the add-on card and he had signed all the slips. And how do i get the sms print? i have checked with all shops but they say sms cannot be printed. I have saved them on my memory card.And also would like to know under which law i can file a case.thanks

under IPC for cheating , forgery .

in your complaint you mention that you have not signed transaction slips .

however have you intimated the bank ?

if it was done without your knowledge as soon as you became aware of facts you ought to have immediatedly informed the bank .
