Credit card due

Dear experts:
My father passed away in the month of May 2017. He is 67. He holds credit card from private bank. We have visited the branch along with death certificate for the purpose of closing his bank account as well as credig card.

But, bank employees not accepted our request due to credit card due. They told, my fater took personal loan againt credit card and it should repaid before closing the credit card account as well as bank account.

Therefore, I was receiving many calls from credit card recovery agents. Each time I told that, I'm not proper person to whom you are calling. The account holder deceased and we have death certificate. In July 2017, some one called from chennai and told that, If I repaid 16K then card will be close and I will received closure letter after 15 days. I paid by cheque, but nothing I received.

Again, in Aug 2017, someone recover agent called and ask for Rs. 1,500/- He told that, the previous person made wrong calculation. Therefore, the credit card not yet closed. If I paid Rs. 1,500/- by cash then it will close and I will receive closure letter within week. I paid but nothing I received.

Now, someone calling and demanding Rs. 1.0 lac. I asked for account closure letter. But, he given 'credit card settlement latter' and it says that, my father has requested for settlement due to his financial conditions. Therefore, bank has given 3 instalment.

I told that, my father was died and how he requested for credit card due settlement. But, they were not giving proper answer and demanding Rs. 35.0K immediately. Further, I asked that, how a senior citizen can get 3.27 lac as personal loan without any proper income proof. But no proper from them.

Now, please advice what I can do?

Simply ask them to provide latest detailed statements for the last five months of April, May, June, July and August, 2017, i.e., debit/ credits during and after her life time. to know the factual position. otherwise, you can't get the real facts about the card.

That is necessary for you to know before you can fight for your cause.

Dear experts,
I have visited personally along with my mother and death certificate, to close the bank account as well as credit card account. But, the bank employee told, they can't close both account, if there is credit card due. I requested to close the bank account only and retain the credit card account. However, they denied and not accepted death certificate. I have tried to visit bank manager. But, the bank manager denied and not allowed me to enter his cabin.
Then, I send email to customer care, by using netbanking facility by mentioning the death event and requested to close both the account. But, that request email remains unanswered as on date.
I handed over death certificate 2 times to collection agents. However, the death event not updated in the bank data base.
On 22/09/2017, bank collection agents themselves raise the settlement request in my father name and I received the acknowledgement email from customer care. The settlement request states that, my father unable repay his credit card dues due to his bad financial condition. Yesterday, they visited to my home, along with that settlement request and demanded Rs. 35,000/- immediately.
All are telling that, the death event updated in the bank database. However, I called customer care and confirmed that, death event not yet updated in the bank database.
Further yesterday, one person introduced himself as deputy manager, told that, just 3 months before he called my father spoken with him. Also he told that, he is good friend of my father. However, my father is in hospital due to cancer more than one year before his death and not able to speak anyone because of his throat cancer.
Yesterday, one person came to my home and shouting that, if I’m not pay Rs. 35,000/- immediately then they will file petition to the Court, then I should face legal proceedings as well as imprisonment also.
I told to that person that, it is not my dues. It is my father due and he is no more now. Therefore, I want consult legal expert. Therefore give some time. I will visit my advocate and discuss the matter and I will do as per my advocate advice. But, they are not ready to listen and shouting in front of my home.
My question now, why bank not updating the death event? How they are raising false request in my father’s name even my father is no more today? How can I take legal action against bank and bank employees?

Don't get panicky. They can't recover even a single penny from you for the credit card dues of your father. It is your sweet will, if you want to clear the liability of your father. But, you must be sure about the dues. Anybody asking you for settlement, may be a collection agent, greedy for earning commission on the collected amount. Deal with them with stiff hands. No bank official comes to the residence of any person merely for collection of credit card dues.If any such person comes to you and represents himself as a bank employee or even be a collection agent, just ask him to first receive the death certificate and acknowledge receipt by noting his identity card No. on the acknowledgment.

Nobody can drag you in the court for clearing credit card dues of your father. Just remember, the bank did not get any consent from you to issue credit card or your guaranty to pay the dues for and on behalf of your father when any default arises.

Then ask them to produce their identity card, take photograph by your mobile phone as well as the person approaching you. Ask them to produce the latest copy of the credit card statement. Immediately call police control room dialing 100 and tell them about their threat. They will immediately run away away. Make a police report against any such person calling on you.
