never....

it will be highly strange thing to happen if done.

No judge at any level can convict a person for an act which is not an offence under any law.
G. ARAVINTHAN (Expert) 10 September 2008
According to me a magistrate does not have power to convict a person who has not committed any offence under law of land.

How can a magistrate charge and convict a person? .. say me some illustrations?
sanjay kumar patibandla (Expert) 12 September 2008
It is very impossible. Magistrate has to act with in the boundaries of laws.

If did so no meaning in judicial process
