Contract for marriage

(Querist) 21 January 2014 This query is : Resolved
Hi, I have a boyfriend. We are in relationship for past 2 years with ups and downs. Now he agreed to marry me but under some conditions. I dont trust him so I asked him to make a contract on stamp paper, then he and me can sign it. Is such a contract for marriage valid according to Indian law? If so I want to add a condition that if I satisfy his conditions but even after that he is in relationship with someone else /engaged to/married to someone else that relationship/engagement/marriage stands cancelled. Is it possible to have such a contract. Please help me.

marriage is all about trust . even if you lay down conditions your hubby can always cheat you on the sly . better learn to trust him or move on in life

What a great idea! Do you think the whole life after marriage is also a business-like contract between the two married persons? If any of you don't have any trust over the other, better part your ways than making a married life as a hell to be regulated by a contract agreement for the whole life.

If you trust any body never raise doubt on him.

If you have any doubt on anybody, dont trust him.

Hi, I understand your viewpoint on marriage. But my question is, a contract like that is legally feasible in India or not.?
ajay sethi (Expert) 21 January 2014
it is not valid . marriage cannot be cancelled if your husband is in relation ship with some other lady . you have to get it dissolved by court orders of divorce .

Is it a Regd or Unregd documents. Both are not enforceable. Better get your marriage Registered in Registrar Office for your safety and you could have the Ceremony when you both wish.He would be yours always.

Such agreement is illegal. Marriage is governed by Hindu Marriage Act.

You may better read Hindu Marriage Act along with Contract Act before entering in to any agreement.

Agree with expert PS Dhingra ji, read both law first. It can not be broken without divorce through court.
