Consumer protection act

Querist : Anonymous (Querist) 07 July 2022 This query is : Resolved
can evidence be led by opp. party in a consumer complaint where no written statement is filed

Quick Summary
In a consumer complaint, the opposing party generally cannot submit evidence if they haven't filed a written statement. While both sides have the right to present their case, failing to file a response means forfeiting the opportunity to submit evidence. The opposing party might still be allowed to argue the case, depending on the court's discretion.

Hello,

Yes, I agree with Goyalji. The opposite party missed the opportunity when he failed to file WS / say. Now he can only argue the case if permitted by the court.
