Consumer commission judgement.if infructuous?

Querist : Anonymous (Querist) 06 July 2023 This query is : Resolved
Consumer complaint was filed in the year 2018.Thereafter no followup was made by either parties. But the case.was.in currency. The complainant in the meantime got the claim fully settled. Now the commission has passed orders awarding claim and penalty. The order is ex-party. What is the procedure to rescine or nullify the order?
Quick Summary
If a consumer commission issues an ex-parte order after a complaint has been settled, and no follow-up has occurred, the usual procedure is to file an appeal. Since the commission itself may not have the power to set aside its own ex-parte order, appealing to the State Commission is the recommended course of action. This allows you to present the settlement details and seek an appropriate resolution.

Since Consumer Commission has no power to set aside ex-parte order so you have to file appeal against ex-parte order/judgment before State Commission and prey to pass appropriate order on basis of settlement arrived between parties.

Yes, filing appeal in the appellate forum is the only remedy.
