Confiscation in NDPS case

Conviction has been ordered for carrying 10 Kg poppy Husk in a car.

Confiscation Proceedings regarding car are being held now.

Whether the Car SHALL be confiscated
or MAY be confiscated?

The car would be seized, and you have file for release of the car, undertaking to produce it in the court whenever necessary.

Yes. The case may be seized for involving with that said offence.. After enquiry you can file a petition for return of property. Till the end of that case you can't sale the said car.

The trial has ended and the accused has been convicted.

My query is whether the fine can be imposed instead of confiscation?
