I would like to know whether the offence under section 406 I.P.C. is compoundable or not in view of amendment Act of 2008. the offence is of May 2009 and today it is to be compounded. whether it can be permitted by a court

Offence under sec. 406 is compoundable with the permission of the court. There can be compromise b/w the parties.Even prior to amendment also it was compoundable,i.e, offence under section 406 was compoundable in the original act. Under Section 320(2) Cr.P.C., the offence is compoundable, with the permission of the Court, at the instance of owner of property in respect of which breach has been committed.The condition is that only with permission of the court offence can be compounded.
