Civil suit case status

Querist : Anonymous (Querist) 22 October 2011 This query is : Resolved 
X is Father and Y is married son.X has filed a suit against Y that Y should vacate family house because of the property dispute and X use to think that Y is harrassing him but couldn't prove it.

Now the case has come for hearing.Court notice has come for hearing on Y's name but meanwhile X is expired at his daughter's place in other city.I would like to know,what will be status of the case when plantif is expired before the case has come for hearing.

we don't the full details. why the father (X) filed suit to his own son. Is the property is self occupied or from his parents .
better to find a good lawyer nearer your place and seek advise for the same.

on the court being informed about the death of X . the legal heirs can continue the suit if right to sue survives .

chamber summons will have to be taken out to bring the legal heirs on record

When a plaintiff dies his LRs has to be substituted provided the cause of action upon which the suit was based still survives BUT ON CIRCUMSTANCES MENTIONED I DO NOT FIND CAUSE OF ACTION SURVIVES.

SO AS AND WHEN ANY SUBSTITUTION APPLICATION COMES TAKE AN OBJECTION THAT CAUSE OF ACTION DOES NOT SURVIVE AFTER DEATH OF HIS HEIRS AS YOU AND OTHER HEIRS ARE NOW ON THE SAME FOOTING WITH SAME RIGHTS.
