I HAS STARTED SUB CONTRACT IN MUMBAI OF INSTALLALION OF PIPED NATURAL GAS FROM S K CONSTRUCTION AND SIGNED AGREEMENT AND COMPLETED WORK , SUBMITTED BILL ,RECD CHEQUE OF Rs.3000000/-(THIRTY LAC).CHEQUE WAS RETURNED AND THE PERSON PROPERITOR OF SK CONST HAS DEACTIVATED ALL HIS MOBILE NUMBER .HIS OFFICE AND HIS HOME ARE UNDERTAKEN BY OWNER .HE IS MISSING AND MAY AT HIS NATIVE PLACE BUT HIS BROTHER TELL WE DONT HAVE ANY CONTACT WITH HIM AND WIFE OF SK CONST AND CHILDERN HAS STAYING WITH HERE BROTHER FROM LAST 4 MONTH.HIS BROTHER IS TELLING LIES. WHAT LEGAL WAY TO CATCH HERE AND RECOVER AMOUNT .

what do you mean by words his office and his home undertaken by owner.
you can seek to issue legal notice for cheque bouncing at the address of firm mentioned in the contract

It appears premises of his office and residence were leased out and when he absconded the same were taken over by the owner.
Besides advise advanced by Mr.Sethi,a FIR of cheating should be lodged and if he has properties,a petition for attachment before judgment should be filed in the suit of recovery.
Try to inquire has he got payment of the work from principal for the work done by you as sub contractor and has encashed the
amount so received,if so then he had intention cheat you since very beginning.

Sir thanks for reply .amount has recd by sk const and given to me .notice was given by lawyer by register post and it came back and under remark of NOT KNOWN .lawyer has directly send notice to sk const and fir is nt filed .kindly guide what to do.
