Case pending in karnataka adminstrative tribunal

(Querist) 03 November 2013 This query is : Resolved
sir,
I filed an case against the Govt of karnataka and Accountant General and Deputy Director of Treasury in the year 2006 challenging the order passed by them reducing the pay by an increment and ordering recovery of excess payment on the ground that my pay has been wrongly fixed in the year 1994 that is after 12 years and that too without giving notice.
But matter has so far not come up for hearing in the KAT as I have now already retired
Question is whether should i with draw the case and put up with loss of one increment? If So what is other legal remedies available other than waiting to conclude the case in the KAT so that i can get back one increment denied to me from the year 2006?

There is something fundamentally wrong in that the matter is pending so long in KAT. Is this your first hand knowledge or as told by some one else? If so, what is the present status - whether OA admitted, pleading completed?

Retirement makes no difference. Service matter could only be agitated in the Tribunal save a Petition in the Supreme Court under Article 32,

It is told by My lawyer that it is not coming up for argument due to shortage of bench strenth
yes OA admitted in 2006 itself notices issued to respondents and counter furnished by them
pl suggest me whether i can get actual status by filling application RTI?
No harm coming in pending judicial interest?
P. Venu (Expert) 03 November 2013
Yes, you can get the information under RTI Act.

ascertained the status of case through RTI and found that it has not come for hearing after 2007 till now even after respondent filed his reply
Any legal remedy?
