Case filed against me under 279 and 337

Querist : Anonymous (Querist) 27 December 2023 This query is : Resolved
Hi All,

Seven years ago, a case was filed against me under sections 279 and 337, and it is still ongoing. My bike hit the another bike and I never assume that guy will file a case against me after 25 days of accident. it was a very small hit to each other. The last time, the magistrate informed me that I could either compromise with the other party, appeal in a higher court, or accept guilt. My question is, if I am charged by the court, will it have any impact on my passport request? Additionally, what should I fill in the passport application form regarding the fine? Please suggest the next steps to resolve this matter. Your suggestions are greatly appreciated. Thank you to all members

IPC sec.279 and 337: If you accept guilt you will be punished and it impacts for passport etc. When you hit another bike, did it cause injury to the person riding another bike? When it is a small hit trying for an amicable settlement of the issue is the best thing. Otherwise, legal implications may arise.

You may better settle the matter amicably with the defacto complainant to avoid legal consequences especially with regard to the passport verification.

Yes, to avoid legal consequences better settle the matter with complainant.

Thank all of you for your suggestion. I'll try to settle with complainant but if he will not agree for settlement in that situation. Do I have any other option.? Can I ask a concession under section 12?
T. Kalaiselvan, Advocate (Expert) 30 December 2023
If he is not coming for an agreement or compromise then yo may challenge the same in trial court and get it dismissed on merits.
