can a businessman practise law?

Querist : Anonymous (Querist) 08 November 2009 This query is : Resolved
I am a final year student of law going to complete law shortly. I am already doing business as a proprietor and a managing director of a firm. In future can I represent the cases involved with my firm and also practise law for others. ?
Raj Kumar Makkad (Expert) 08 November 2009
No. Managing director or a proprietor of a business is not entitled to practice as an advocate and cannot plead the cases being an advocate.
Khaleel Ahmed (Expert) 08 November 2009
You are advised hereby, you are not eligible to enroll your self as advocate being proprietor and managing director. To represent your own cases you need not be a lawyer, you can represent your cases as party in person.
Kiran Kumar (Expert) 08 November 2009
you can do another thing, keep a license as a lawyer....and for business you can run it in your spouse's name.

if not married now then u can run it in the name of your parents.

if you are not to practice law in regular manner then you need not to take so much of agony....first hand knowledge of law is enough to serve your purpose, atleast in your personl cases u can appear in person.

You can be a sleeping partener in a business and practice as an advocate.

In future you can represent the cases involved with your firm without having a degree of law. But can not practise law for others. Degree of law and registration in the bar is must.

u can appear in person in the case, but u cannot conduct the case as an advocte of the firm, because u r in the capacity of partner in the firm and u want to defend the case as an advocate, you cant do double role.
Poonam Upadhyay pathak (Expert) 29 November 2009
I do agree wit the opinions given above but u can follow the advice of the Kiran sir.
