Property

Sir,
My parents died in 2004 year. My father had executed WILL during his lifetime. I have applied for Probate of the WILL in the year 2010 and is still pending as she is opposing the WILL. My sister orally threatening to file partition suit by bypassing WILL for the last ten years but not done till now. Neither is she filing partition suit nor allowing us to do transaction in our property. As per partition laws within what time she should claim partition in the context of her opposing Application for Probate of the WILL. As per partition laws what is the time limit to claim partition of property?

Cheque bounce case

Dear Sir,

Due to family disputes my self and my parents are staying away from by brother .In order to harase us, initially my brother has filed one chq bounce case ( my old account unsigned cheque leaf was with him ) for Rs.2500000/- in his friends name, and I have received cheque bounce notice from my brothers friend.

After receiving notice I had approached my lawyer and he had prepared reply for the notice. In the reply my lawyer had pointed out that my client (i.e me) is not aware of your client and due to family dispure between my client his brother thye could have forged the cheque and send a chque bounce notice against my client" and sent the reply to openent lawyer.

Now my brother has sent defemation notice against me claiming that me & my lawyer had made wrong full alegations against my brother in the reply which we had made against which I should pay him Rs.42 L as damages with in 7 days and Rs.1500 towards lawyers fee.

Now what are options available for me to proced against my brother legally.

1. Should I reply to the defemation notice which I had received or
2. Should I approach police.

Sharing of expenses for leakage repair above my flat.

Dear experts,

Bathrooms and WC leakage is coming from top flat. The flat owner is arrogant and not repairing and some time not even allowing us to visit his flat ascertainment. One plumber gave estimate of Rs.20000/-. to be shared by both. He was telling this amount is being charged more. Blumber told to replace junk pipes in wall breaking some tiles and replacing them.

He called another plumber & now saying he wants to replace both bathrooms tiles & flooring fully including main repair jobs. He says for all this another plumber quoted Rs.60,000/-. He is now demanding 30000/- before. I told him I will share for repair work as per earlier plumber quoted Rs.20000/-. If you want to make new bathrooms you have to bear remaining. He dumped the telephone and not co-operating nor repairing his bathrooms nor allowing to enter into room. My queries are as follows:

1] Whether I am bound legally or as per bye-laws of society to pay for repair in bathrooms & WC to be repaired in his flat for leakage coming from his flat to my flat?

2) He is adamant and beyond understanding if does not repair despite sharing reasonable amount of 50%, what is next remedy, legally or otherwise immediately?

3) I showed the damage caused due to drifting of leakage water to ceiling, even in rcc pillar. The damage cannot be quantified but clothes and other material is damaged. Can I recover from him ?

4) Suppose huge expenses incurred, can they be demanded from Society for internal leakages since building's structure is going to be week due to such leakage, though internally? Society has also undertaken external repair work recently.

5} If complained to Society, society normally take stand that it is internal matter, both flat owners should settle it.

Your sincere and significant advise is solicited. Thanks.

Dear Sir,

We are a housing society registered in January 2104.

We are now in the process of issuing share certificates to our total 67 members (61 residential and 6 shops in front of building)

Can you please guide us re the process? Also, do we issue 5 or 10 shares per member? And will the value of each share be Rs. 50 or Rs. 100?

As chairman of the society, I will be highly obliged for any help rendered re this issue.

Thanking you in advance and in anticipation,
