A partition suit was filed in 1991. The case went on till 2000. Thereafter evidence from both side was concluded. As there was some possibly of amicable settlement both the parties left the case and it was dismissed for default. The amicable settlement did not materialized and quarrel broke out between the parties and several criminal cases was filed on one another. Some of the criminal cases are still pending. In the meantime one party has filled application for partition in the year 2011 before Director of land record under a new act. But there is a possibility of this application being dismissed because the section under which the application is filed before the Director is termed ultravirus by the high court.
My question is whether after the dismissal of the application the parties can approach the civil court for Restoration of the earlier partition suit. I may point out that in one case supreme court said while deciding condonation only technalities should not be seen, the delivery of justice be also seen.

Sir,
in a land case which is under consideration at revenue board Lucknow and member(J) had ordered to submit a report on the said land issue by Naib tehsildar.and now Naib tehsildar has submitted the false report without original revenue record and mentioned the false rules in his report.May i challenge it to superior court as i have original records and correct rules pertaining to UP land act.Sir, Please guide how can i keep up my favour against the false report.Thanx sir

One of my friend's mother belongs to hindu religion has three children, she made a settlement deed of her property to her eldest son that the settlee will have sole ownership of the property after the life time of the settlor and the other children of the settlor of the first part are absolutely banned from any stake in the property but the settlee died before the settlor. Settlee was a divorcee and no issues.The settlor like to sell the property so we approached to the concerned sub-register office to cancel the settlement deed but the official told no need to cancel the deed, the described property automatically goes to the settlor. Is it correct? She can sell the property without cancelling the settlement deed? Waiting for your valuable suggestion.

Hi All,
I was working for a PVT LTD company in gurgaon for more than 3 years , All of sudden they asked to me leave and said you are not performing well , you can leave this organization ( Verbal ) so i resigned on september 26/2014 . as per managers they agreed my full and final will be done in coming pay cycle which was oct 7 2014 but they didn't clear my dues till now . When i went to office to ask the reason , next day they sent me an email that i am threatening their employees and i breached code of conduct stating I have conveyed in America ( Onshore company ) that i have opened a company of a similar nature and the same was given as a feedback to my new employer which was Convergys so they terminated me based on that. I have a termination letter from them only. they mentioned in Email that they will talk to their office in America and then they will tell their final decision . It's been 4 months now, i sent them many emails to clear my dues , to tell their final decision but as of now i didn't hear any positive answer . however they sent me a notice with lot of base less allegations in November , I sent them reply of their notice on 26th of december by speed post and had given 15 days time to reply . Till now no reply from them . As a proof i have that long email conversation where they have been tolerating by giving excuses, signed copy of resignation and Termination letter from convergys where this has been stated " Due to false information given by employee " . What should i do to save my 3 years of experience and to get a new job plus to get my all paper works with full and final from them .

Respected Sir/Madam,
My wife has lost her memory completely, she is physically and mentally abnormal due to the side effect after outcome of suicide attempt(hanging herself). Now she is living with her parents. My in-laws filed a case against me u/s 498(A), case is under trail in court.
My twins girl childs(4 years) are with my in-laws.
How can I take back my childs from in-laws?
please advise me?

MANY MANY THANKS FOR YOUR VALUABLE GUIDANCE.
BUT I WANT TO SAY TO ALL THE EXPERTS WHO GAVE THEIR VALUABLE OPINION THAT "THE PROPERTY IS NOT DEMARCATED" IT IS A JOINT PROPERTY AND ALSO "MY FATHER HAD NOT LEFT ANY WILL". AND WE ARE ONLY THREE MEMBER IN OUR FAMILY, ME,MY BROTHER AND MY MOTHER.
SO ACCORDING TO THIS CONDITION, ARE THEY ABLE TO SELL THE PROPERTY INDEPENDTLY.
IF YES,
THEN CAN I SELL THE PROPERTY OF MY SHARE ? WITHOUT ASKING THEM.
PLEASE SUGGEST ME.
AND LAST.
TODAY I HAD MET A LOCAL LAWYER FOR THAT CASE,HE SAID ME TO COLLECT THE INFORMATION FOR THAT PLOT WHICH HAS TO BE SOLD BY THEM AND I HAVE COLLECTED THE INFO FROM REGISTRY OFFICE.AFTER THAT THE LAWYER SAID ME THAT HE IS GOING TO SENT A NOTICE TO CIRCLE OFFICER (CO)OR DCLR OFFICE OF MY BLOCK TO STOP THE MUTATION PROCESS OF THAT LAND AND AFTER THAT HE WILL FILE A SUIT FOR PARTITION.
AM I GOING IN RIGHT WAY OR NOT.
PLAESE GUIDE ME.

Dowry case 498a
My wife filed case against me in section 498A and on my whole family members but any how my family members got bail and i am staying out of country after waiting for so long time near about 16 months i have sended divorce papers because whenever we are trying to solve the problem my wife mother use to say no don't want to do compromise so finally i have sended divorce papers and now my doubt is if police submitted my charge sheet still they will arrest me if i go to my home place or no why i am asking this because of the officer who is handling my file he call us for asking my family members bail papers then he can submit my chargesheet as he told us its correct or wrong i don't know
