What is maximum punishment under section 13 of pc act. I heard abt that pc act undewent some amendement

Validity of compromise decree of partition in highcourt

We are unknown about compromise decree of partition in Mumbai Highcourt in the year 1964. In some part execution of decree is not happened. Can we do partition of land according to decree after 50 years.

Inherent power of hc

A govt servant with support of various documents collected through RTI, is willing and ready to prove his innocence. whether HC in its inherent power can quash FIR charaged u/s 7 and 13 of PC Act before charge sheet not filed. Some of the documentary facts below:

a) Vigilance arrested an officer based on Civil Contractor (A)complaint
b)But Work order and bill was prepared in the name of (B) (RTI doc)
c)Security deposit receipt originally raised in the name of (B) and erased the name to (B)(copy of chalan xerox)
d)Measurement Book was prepared in the name of (B) and subsequently scored out and written as (A) (M.Book should not be scored out. Its a legal document)
e)A&B were forged and prepared number of commercial tax certificates Form.S and got about 20 lakhs VAT evaded (RTI docs)
f)the officer being taken legal action against A&B reg lack of quality control works is a ongoing matter.
g)25 days before the complaint of A legal notice was sent by officer to A&B
h)officer stayed through HC for not to payment 3 work bills of A&B Rs.55 lakhs until further orders
i)Moreover HC sent notice to department higher officers based on the officer charged on the concerned Asst Engineer who colluded with A&B in all aspects

Fact and conspiracy is, contractor B impersonated A with the collusion of Asst Engineer who is the authority to prepare tender documents.

Kindly advice whether quashing of FIR is possible under this circumstance

Whether an authorised signatory of a company would be liable

Whether an authorised signatory of a Public Ltd company would be liable for prosecution under Section 138 of the Negotiable Instruments Act, 1881

Once he issue the cheque and cheque is dishonour now he is trying to remove his name

Please give me some judgements showing that "whether an authorised signatory of a Public Ltd company would be liable"

Interim maintenance

Dear All Lawyers,

My wife has charged me for domestic violence and she left me immediately after 2 months of our marriage and we have a baby boy. Now my salary is 18000/- per month. I have seen my wife working in one matrimonial company before her delivery and she is MA in English Literature. But I have no proof of her employment. But I know the place where she worked. Also I don't know if she is currently working or not. Interim maintenance will be finalised on 1st March, I need your guidance. Please tell me how much I would have to pay from my salary?

Withdrawal of suit by compromise

Facts - Authority X levies charge on Party Y.
- Ld Single Judge (in Appeal by Y) strikes it down by holding that it has no power of levying the said charge.
-Both the Parties files Appeals before Division Bench; matter pending
- Parties reach a compromise wherein Party X can levy the charge but it is reduced as per wishes of Party Y;
and both wish to withdraw their respective appeals.

Proposition - Can Party X & Y withdraw their Appeals based on a compromise, in light of the fact that Ld Single Judge struck down / set-aside the power of levy itself.

Divorce on mutual consent

Sir,
We filed a petition U/s 13B of H M Act 1955 in June'2015 at Barracpore Court North 24 Parganas (W.B.) and after final hearing in Jan'2016 I was informed that The Order was passed.

My question :
1. I have tried a no. of times to see my case status from Barrackpore Court web site but every time when I put my case no. .....the reply is record not found. I have also tried by putting party name but result is same. Are the all cases not uploaded in web site ?

2. Can I myself issue a Certified Copy from the the concerned department of the Court directly. If so please suggest the procedures.

Epf withdrawal by nominee

Dear Sir,

One of our employee got expired during the employment. He had made his maternal aunt as a nominee. His father is alive. When we submitted his claim form for PF withdrawal through his aunt, the department has rejected it. The reason of rejection was given that only parents can claim the same. If both the parent are dead then a decree from the court will have to be submitted by the Aunty along with the form.

My question is what is the relevance of nomination form 2(r)? or is it mentioned somewhere in the act that only parents can claim the fund. even the member has nominated someone else.

can we sell land only on basisof death will created

My Grandfather was owner of land which on his name till date.not trasfer to anyone.but in his will he has mention to give that land to all members of family.his own legal hairs and his brothers family..
Can this possible to sell land only on basis of will..or need to first transfer property on people mention in will?
