Moot court

A is working as a Driver with the Managing Director (MD) of Food Corporation of India (FCI), a central govt. undertaking for the past five year at Chandigarh.

On a usual day of work, the MD instructed the driver to get some important document signed from the Ambala Branch. The MD added that he must report back to duty before noon the same day.

R, a Driver in a private concern- Jayco Co. As cousin used to live with him. When R came to know about As visit to Ambala the next morning, he offered him lift as he was also going to Ambala for Cos work. A agreed to accompany him and the two started in Jaycos Co car at 8 am.

On reaching Ambala, R dropped A at the FCI branch while he himself accomplished Cos task, on his way back. R picked A and started journey back to Chandigarh at around 10.30 am

On the way back, near Derabassi, A insisted R to let him drive, as it is not very far off and also that R should take some rest. After much insistence, R yielded and handed over the steering wheel to A.

A drove at high speed and the vehicle could not be controlled by him. As a result, at a blind turn, the car collided head on with taxi approaching them from the opposite side. Two passengers alongwith a child and taxi driver got severe injuries. In this accident whereas A died on the spot and R died on the way to the hospital.

Legal heirs of A filed case against FCI.

Legal heirs of R and Jayco Co are filing cases against legal heirs of A and FCI.

Taxi driver and passengers are filing cases against R, Jayco Co, A and FCI.

Different views are possible the view which favors the accused must be considered

As per thecatena of Judgements made by Supreme Court that When several views are possible the view which favors the accused mst be considered an the High Courts must refrain from passing any orders and this has been published in lawyersclub also

If so then why he Sates and CBI file appeal against acquittal made by trial Courts and Why the High Courts admit such CRLLP filedand pass orders against acuittal

Secondly When a trial court convicts and th High Court Acquits Why the Supreme Court admits SLP (Crl) filed by the bodies in Supreme Court. There are more than 4000 cases filed aginst acquittal pending in Supreme Court sections whichdeal in Ciminal matters

Indian succession act

I am occupying property as tenant and paying rent continuously without any default.
Last one year cheques issued by me towards rent not encahsed.
last month i received received notice from court to appear before it along with application filed by executor for direction with respect to rental income.
I have appeared before court and found that owner of rented property expired and appointed executor by will. thereafter executor filed probate petition, probate petition has been challanged by other legal heirs of rented property and matter is sub-judice.
As i already stated that I am regularly paying rent and bonafide tenant .

But my concern is if i pay rent and probate not granted in favour of an executor and another heirs filed suit for recovery of rent then i suffered loss and face legal proceeding .
pls. advice me and suggest any judgement on matter that tenant need not pay rent to executor till disposal of probate petition. copy of application and reply attached herewith for reference
