Time limit for starting disciplinary proceeding

An employee of a private limited company has resigned from service in end of Jan'16. Till date the employee has not given release by the company nor his final dues settled. Now the company intimates that they intend to start disciplinary proceedings against him. Is there any time limit within which such disciplinary proceedings has to be started in case of private limited company? Is there any case laws which can be cited in this matter.

regarding adoption of child

During 1950, my parental uncle & aunt, who were married hindu at that time, were given the responsibility, by their family elders of that time , to braught up a female child whose (child's mother)had expired immediately after birth of the child and her biological fatther also died in 1960s (both deceased were also family relatives) .. And the child was thus brought up, educated and got married by my uncle & aunt, since 7/1/1950 )but With keeping name of her biological father on her educational records, which shows no adoption made. Since my said uncle & aunt had also expired, hence, what is the legal status of my cousin sister's father under laws.. However, my aunt (who died later by my uncle) had made a will in her favour mentioning in the will, which is reproduced "
"... yeh ki mere koi aulad nahi hai. Maine bachpan se hi "xxx Sharma" ko goad le liya tha. Jisko maine aur mere pati ne hi pala va padhaya tha tatha uski shadi ki thi jiska ki vayvahar mere sath achha hai aur meri sewa karti hai..."
Is it a misdemeanor if she has mentioned name of her 'adoptive' father instead of biological father, somewhere else ? if so, how to rectify it Please guide..

Can unregistered soceity can purchase land.

Sir,

Respected Members and learned Advocates,

My client which is a Society having President, Gen. Secretary, Treasurer and other office bearers. But it was not registered under Society Registration Act. In the year 2011 it had purchased 1000 sq yds of land from a vendor in the name of the Society as Purchaser. Before purchase we had verified the title. We have paid total sale consideration and possession had been handed over to the soceity. The sale deed has been registered in Sub Registrar office. Now the President, Gen. Secretary, Treasurer and other officer bearers have been changed. All new persons came.

Presently, my client is the President of that unregistered Society. My concern is that whether the title had been really passed on to the society (which is not registered). If not, what is the procedure to be followed to rectify the mistake and the property should be transferred in the name of the Society. Now we are in the process of registering the Society under Society Registration Act.

Your kind advise is solicited.

Tds on purchase of property

In respect of TDS u/s 194 IA , kindly clarify the following:

1.When is the tax to be deducted in case where on if the agreement is made (whether or not registered) and payment is made for next many years in installment upon demand from the seller? i.e whether credit would deemed to be given to the seller and TDS to be deducted there upon ?

2.What if the buyer fails to deduct TDS and in turn non payment to the government account as well?

3.Will the benefit of proviso to Section 201 (1) and 201 (1A) can be taken as shelter by the above buyer?

4.Since Tax is never deducted and thus not paid to government department, filling TDS return will still be applicable and thus late filling fees of RS.200 per day also be applicable?

5.What if the above happens because of a genuine absence of knowledge with regards to this provision?
