Joint tenancy.

Greetings to All!!
Query:-

(Mr A) holds a property jointly purchased along his two brothers(Mr B and Mr C) in 1975.
In year 1994 mr B expired who was just a sleeping owner with no possession and to title in the premises except his name in the sale deed.
Since In 1994 Mr.B expired and since mr. A was in the possession of the constructed factory in the premises,mr C also gave the power of attorney to mr A as he was also not involved in any affairs related to the titled land.

however in year 2007 widow of mr B filed a suit against Mr A claiming the share in the land as legal heirs of the deceased (Mr B).

Please confirm is his suit admissible?as the land was jointly held (jointly tenancy) How strong is the case of Mr A.

regards
Sunandhan

Charge absent from final chargesheet

A lady had accused me of grabbing her breast and using bad words against her.An FIR was registered U/S 354, 504, 506 IPC. In the Chargesheet based on witness accounts the police have only charged me U/S 504. The witness statement states "She abused him in bad words, he got angry and retaliated by giving bad words. He did not touch her or come near her".Can i now file an application to the court for prosecuting the woman U/S 211 as she made a false charge of me inappropriately touching her i.e. 354 to put me in jail. She has done this to take revenge against me as earlier I have filed an FIR against her for child abuse.

Fir quashing ipc 354,504,427

Dear all,

A false FIR has been lodged under IPC 354,504,427 with help of police by the opponents. I had objected illegal construction at my place, the opposition party was gonna get financial benefits from builder. I had already complaint to police regarding the opposition planning to trap me in false case.

The opposition lady filed a fake FIR that i hold her hand and caused her injury with her own glass bangles, but after chargesheet was filed police have mentioned that i am eveteasing her from past 1 year and hold her hand on that particular day. Police has mentioned nothing of injury in FIR, whereas i inquired from the hospital, the lady has done legal medical on that day. But police has not attached any medical reports neither anything such incidence in FIR.Complainant has also mentioned in chargesheet that she never complaint against me due to fear, but she has already complained against my mother twice before the FIR regarding abusing, and my mom has also complaint against her regarding the same. There was chapter proceedings on complainant as well as on me. There are two witness in the case, against both i have complaint to police before FIR, police had initiated 149 notice and chapter proceedings on both.

The opposition male member had physically assaulted my mom after 2 months of FIR, so my mom asked police to register FIR, but they threatened her that they will file again a new fake FIR against me. We complaint against this to Police Commissioner,State DGP, PG Cell Of Bombay high court and CM but they are still not filing the FIR. We also met ACP and DCP of our zone, but no action taken.

What are the chances of quashing the FIR in High Court.

What would be the next step, where police is not willing to register our FIR and threatning us.

Your expert guidance would be helpful.Though i have hired a lawyer for session court, but my lawyer saying i cannot go for quash, i need to face the trail, but he also cleared that the opposition case is weak, since the matter is civil which they have turned into criminal. Please advise, what possible steps can be taken.

Secondly how do we ascertain the asset details of the Company so that we can file an execution petition in Court against the company ? The Company has not been filing any returns etc to MCA since inception in 2012 !

Property transfer from cidco and conveyance deed

Dear Sir,

I want to purchase property in nerul sector 19. Society is formed and registered in 2012. OC and CC is clear and get in 2003. It is bunglow plot of 303 sq.mtrs and tripartite agreement between cidco, land owner and builder. It is 12 years old property. I will be the second owner if purchased.

First owner have not paid the transfer fees to cidco hence cidco denied me for mortage NOC and transfer of ownership.

Now seller said he is ready to pay the transfer fees to cidco and also processed for conveyance deed.

I have below doubts:

1. Can cidco transfer ownership to me immediately as first owner is going to do it now?

2. Can cidco transfer ownership to me without conveyance deed?

3. Is mortgage noc and cidco transfer required even after conveyance deed?

4. How much time will take to complete ownership transfer and conveyance deed process?

Please suggest.
Thank you in advance

Regards,
