Misc. petition pending

Sir
what is the different between STAYED BY HIGH COURT and MISC. PETITION PENDING.?

7 hearing passed still now from august 2016, always MISC. PETITION isPENDING in my file by family court.

How many times the judge can fixe an hearing while the case is pending before high court.

Please kindly inform me how long the high court can take time for a tranfer petition for a divorce case.

What options are available to legally transfer a immovable property - house , in the name of children and spouse , by the owner of the property in whose name it is registered.

Enhancement of the flat value

I have registered my bare flat for Rs 15 L. I have spent another Rs 5 L on the interior and furniture . Can I add this amount to the flat value so that later , when I sell the flat ,I need to pay CG only if the selling price exceed Rs 20 L ( 15 + 5 ).

Contract issue

We shifted in our new house and we find that many places plaster is uneven which is now visible to us after paint is done . Secondly our boundry wall design is also dissimilar due to which it is looking awkward . We have told contractor about these problem and in reply of that he say that why didn't you tell me when plaster work was going on ? As I have already mentioned that these problem are visible only after paint is done so how can we detect earlier.
It was written in our contract that last payment will be given at the end of work only after we are satisfied with his work .
He also didn't finish the work in given time period. He took 45 days extra.

My father works in police wireless department so our contractor has given a application to superintendent of police in which he mentioned that we haven't given his remaining money . This morning one known person from police has called us in evening to settle the issue between both the parties.
So I want to know that are we bound to give the full amount or what can we do in this case.

Delay in full and final settlement from employer

Recive from a friend:-

i was doing job in a company as manager sales from 2 and half year. I left job on 31/03/2017 and till date company fail to give full and final settlement payment to me. What I do becoz it is already 60days gone company's HR didn't pick my phone and also don't meet me when I go to office.
And behave like a peon with me..

Regarding transfer of property if vendor is residing foreign

My family is residing at haridwar and on which house we are residing it is on my fathers name and my father is living in london and he will not come to india so he decided to transfer that property in my name what is the procedure to do so and the propert is outside nagar nigam of haridwar and i am the only child of my father and my mother has been expires.
and also please tell me what procedure my dad should follow.

What is the procedure to start an online education business?

Hello,

My wife wants to start an online education business. The courses will be like-
financial planning,Investment management etc.

We don't know the legal process before launching the online business.

Please provide advice regarding the following-

1. Can she start her business from her parents' home address in West Bengal? Is NOC from parents or commercial power connection or any other documents required then?

2. She wants easy to manage paperwork for her business. Which type of business structure should she form- partnership/LLP/PVT LTD?

3. What licenses should she get - Municipal Trade license,VAT,CST, GST?

Registration of flat by 7/12 owner

We are living in Maharashtra . Thane district Badlapur. My father is owner of land ( 7/12 is on his name) which he gave for development in 1990 to builder for consideration of 2 flats in building. After construction of building we sold one flat and keep another one for ourself ( in which we are living now).At that time we have not get the flat registered by paying registration fees.( Not paid stamp duty and registration) The society is registered but the conveyance deed is not yet done and my father still owner of land on paper. Now for redevelopment purpose we want to get it register it. But now builder is asking money with market rate from us for registration. Is there any other way from which we can register our property? can my father register it as a seller ? The property was given for redevelopment for developer (They had partnership for construction business) however there partnership firm is not register in registration office( Partnership deed is not there) My father gave power of attorney to builder to sell purchase of flat. But now no once have documents of it (original as well as photocopy)

Falsly fabricated & forged evidences

Hello Experts! I need your advise on this.

Few documents falling under ambit of Section 193, 463 and 471 IPC were presented to the collector in his capacity as Arbitrator. But, he refused to take action as per procedure mentioned in Section 195 r/w 340 Cr.p.c. instead he directed to present the suit in the court.

1.Is his order Sustainable as per section 340 Cr.p.c.?
2.Could writ of “Mandamus’’ be preferred to get him issue directions?
3.What are the chances of writ decided to be in favor?
4. What are other remedy available to necessitate collector to take action?
