locked up for drinking

r/sir, my name is phoja wangsa, studying master in IGNOU. yesterday, i along with my friend were brought in the police station for drinking in public place.actually we were sharing a bottle of breezer in a quiet roadside when the police showed up.. after reaching p/s we found that there's already lots of citizens accused with the same "crime" including 3-4 police person.but the officer bail out the three officials along with some students who were attached with some student union leaders and big officers.. and left us locked for the whole night... is this equality.. was that the way of performing duty.. a lots of questions goin on my mind.. pls help me. what should i do??

RWA Not holding elections

Sir, our RWA, in Sector 72 Gurgaon, Haryana, was registered as a society in Aug 2016. Before its registration the Governing Council comprising 07 members had been elected in an ad hoc manner. These 07 members registered themselves as society, without any debate/discussions on its bye laws. In the bye-laws they mentioned that the term of Governing Council (GC) will be 03 years.
For about one year from the date of registration, no effort was made by GC to enrol members. When residents found that GC was indulging in unfair practices, they expressed their lack of faith in them and demanded elections. Under pres sure, the GC started membership drive and promised that elections will be held after membership drive.
After about three months, now the residents asked for the plan of elections and appointment of Returning Officer. The GC has said no one can force them to appoint a RO and they will do as and when they feel like.
The point is that the GC was appointed in an ad hoc manner and was never elected by residents in accordance with rules laid down by Govt. Therefore after having themselves registered they are obliged to open the membership registration process at the earliest and then hold a proper election.
But the present GC is trying to make money at the cost of residents.
My querry is that what can residents do to force them to conduct early elections? Can the ROC force them to do so?

Solicitor's articleship

Hello Sir. I'm a 2nd year LL.B student, willing to take solicitor exam. I have some queries in same regard. Kindly help me with this.
1. How to get to know under which solicitor one should start doing articleship?
2. What if result of giving 3 years to articleship went in vain, I mean if I failed to clear the exam, then what?
3. I heard that soon solicitor practice shall be repealed, as it only prevails in Bombay and nowhere else, is it true? Shall I not go ahead with the decision of starting articleship? As I will complete law in 2018-19. So any chances of unfavorable changes? I mean if something like scrapping of exam or entire solicitor practice happened during articleship, then?
Please help me with this, Sir. I don't want to waste an year. And genuinely want to do solicitors.

Partition matter

Background

“E”Is the living senior most member of HUF.
A, B,C & D [who were elder brothers and sisters of “E”] since expired.
Each A, B, C &D (since expired) have descendants, say 3, 5, 4, 6, each respectively, and each descendant has his own families - huge.
Status of the matter (in Kerala): “E” the Plaintiff filed a partition suit through an advocate “P” making all living members as defendants.
Question:

This is my case & shall appreciate a considered opinion from experts

(1) Whether, I (defendant in the suit), being a descendant-member, is obliged to pay advocate’s fee to “P” over and above stamp duty.
(2) There is an ex-parte order for partition. Without the knowledge some members, some other members took their shares on the strength of the exp-arte order.

Preliminary issue hearing

Sir i have filed an application to frame preliminary issue that whether the applicant is labour or not. Said aaplication is allowed by the court and now the matter is fixed for hearing on preliminary issue and i have file an affidavit i.e. examination in chief. Please guide what would be the contents of said affidavit. I have already filed my written statement. Please guide.

Getting in to jva with another company

We are running a company and this company owns a successful brand.
Recently, some development happened with another company working in same domain. We mutually discussed on our future perspectives if we go ahead with partnership.They offered us following things

1. They will work as technology partner of our company (tilll now we are outsourcing technology) and invest Rs. 1 Crore in next 1 year as strategic investment. In return they don't want equity in the company they want to co own the successful brand.
2. They want 51% ownership of the brand, its IPR and right to decide.
3. They will deduct their investment on monthly basis, means they will get the profit(if any) and investment also from the revenue.
4. They have the right to terminate the agreement but we don't.
5. If in any case any party want to leave the brand, second party will automatically become the owner of that brand.
There are many more such clauses which are inclined toward that company and its like that they want to own everything in return they will provide technological assistance with investment.
I want your guidance regarding this

Who is the legal heir

i want to know 1) my husband committed suicide three months ago, due to financial looses now my inlaws are pressurising to sign NOC for leaving all the claims to property and i don't want to do that .what should i do?
2) in laws are saying that they will put allegations that suicide was because of me , the will put allegations on me although there was no postmortem done of suicide, no police complaint registration .do these allegations stand in court?
3) is my mother in law also a legal heir to my husbands own property and not joint
