Casein high court

Dear Expert ,
I have a running case in Calcutta High Court .I am not getting any date in the court , as per my lawyer date allotment comes from computer system and no one can control this , hence we need to wait with no clue till the time we get a date.

Is it situation is correct ? No One has control on the date as its computerized . Please help .

In a recent fight my uncle attacked his cousin with a knife.

Hi,

In a recent family fight related to property which took place yesterday my uncle attacked his cousin with a knife. In which his cousin got injured and had to be rushed to the hospital. His current status is out of danger but had got stitches on his stomach. Seeing his cousin bleeding my uncle fled from the spot before the police arrived. We don't know his whereabouts and are extremely worried as to where it would lead us. My uncle's cousin was coming to our house and threatening us from last 1 month and on the day this crime took place he was abusing my uncle's mom and sisters along with him, which led my uncle to lost his cool and get a Vegetable Knife to attack. My uncle is a law abiding person and a taxpayer with no police records in the past. What would be the sections imposed on him ? Is there by any chance we can apply for a bail on his behalf ? Please suggest the best possible solution. Thanking You

Time limit for reply and recording court process on video

Dear Legal Experts and Advocates,

I thank you for providing me with legal advice so far. Its been a humbling experience so far. And I am asking for some more inputs.

Cause of posting this query:

The District Consumer Forum on receiving a complaint, in its judgement dated 4-12-2015 in Civil Appeal Nos. 10941 10942 of 2013 New India Assurance Co. Ltd. v/s Hilli Multipurpose Cold Storage Pvt. Ltd. & other connected matter, decided on December 4, 2015 the Honourable Supreme Court of India delivered by a specially constituted three-judge bench [Justice Anil Dave for the bench along with Justices Vikarmajit Sen and Pinaki Chandra Ghose], has said, the opposite party is required to be given notice, directing him to give his version within 30 days. This time can be extended by another 15 days. This extension may be granted by a District Forum or The State or National Consumer Commission.

Hence the opposite parties have only 45 days time to file a reply for the complaint made against them in a Consumer Complaint from the date of notice.

In my case at the Tumkur DCDRF, the OP has simply come and sat inside the court without coming before the judge/president. for 90 days. The same I have made known to the president via letter.
After 90 days are over from date of notice, one advocate appears and files vakalathnama on 90th day. I objected to president accepting the vakalathnama as it is over 90 days that the OPs have not filed reply to my complaint.

The president said that vakalathnama they have filed. But till the 90th day from date of issue of notice to OPs, nobody came to the judge and told anything nor did any advocate file any vakalathnama.

This is wrong in law, the president is directly commited offence by not following the orders of the Hon Supreme Court of India.

How to tackle this? However I have given letter asking president to pass exparte orders since the OPs have appeared for all the previous dates and not filed any reply till date which was 90th day from the date of issuance of notice to OPs by the consumer court.

Any inputs will be appreciated.

Client not releasing old outstanding

Dear Sir,

I have some outstanding dues with my client since 5 years now and he is not releasing the same. i have obtained post dated cheques 5 years back which was returned thrice due to insufficient funds. Somehow he managed to pass 5 years requesting me not to take any legal actions as he will pay the amount very soon and i trusted him.

i filed an FIR with police station near my office with the help of court 3 years back, police called him at police station but didn't took any action (may be he might have bribed them) instead they asked us to go to court as it is a civil case . Now i cannot file 138 against him as dates of the cheques is passed, secondly i am bankrupt so do not have enough funds to fight against him. he is a billionaire so he can chuck me out where ever i go against him.

what should i do please reply.

Alimony

Gave alimony to wife in mutual divorce. But it is not mentioned in the main petition because she did not ask for it earlier. She took the money and signed the receipt on a 100rs stamp paper with two witness one being her own father during the day of the final hearing. Is this legally valid. Do we need to register the transaction. Already got the divorce decree.

Obc category issue

My wife belongs to punjab lohar cast, which is considered in OBC catogery in punjab.I belongs to himachal pardesh tarkhan community,which is already in in obc catagory, but complication is that lohar cast in himachal is in Sc Catagory.
my wife fill nomination in panchayat election which was reserved for OBC catagory. nomination rejected because cast certificate attached is related to punjab govt. and himachal govt. not issued the cerifcate.
2.5 year last we still fight a case and there is no fruitful result comes out.
is there any judgement regarding this.

Government acquired land 10 years ago but didnt do anything

If the Government acquired the land and do nothing with it for the next 10 years. Then is there any provision to give the land back to the owner. If yes, Please share ruiling or citation.

Attestation form sent by central govt departments before joi

I had taken admission in B.Tech in 2011 and after 4 semesters in 2013, I left that course due to economical reasons and took admission in B.Sc graduation course in another university.I have been recently selected in a central govt job and now I am in dilemma whether I should give details in the attestation form about my B.Tech course which I had left mid-way.Or simply I should give details about the graduation course in B.Sc which I have completed.Will it create any problem if I hide that information because there is one column in the attestation form which asks about educational qualifications including places of education since 15 years of age..

Marriage certificate

Dear Sir,

I am from cuttack orissa and i am staying in hyderabad since 2007. In 2012 i married a telugu girl (native ananthapur ) . The girl along with their family were living in hyderabad at that time.
We dont have any doc proof for our mrg. I tied a mangalsutra in a temple at hyderabad . Then we start living together . Now we live together and having 2 kids.

The problem is now we are looking to get mrg certificate ( for passport purpose) for our mrg. What we have to do..? Pls guide us.

Workman wages if his service is taken for two group company

Dear experts,

If a workman is on roll of a company and his services are also taken for work of other company of same group then according to labour laws whether he can seek minimum wages or justified overtime or suitable compensation for the work he performed for the other company.

under which section or act he should claim these wages for the work done for the second company if he has the documentary proof of taking work of other company by parent company . Whether he is eligible to file a complaint before labour commissiioner that he is being overused without paying anything for the work of second company
