Inclusion of full name in birth certificate

Sir,
My son born on august 2002 has got birth certificate issued from Nagar panchayat of Maharashtra State which only mentions the first name of child instead of child full name. As per the tradition and practice, We add mother’s father name to the second male child along with father name or mother’s mother name to the second female child along with father name. The format is first child name, middle name is either Grandfather’s name or Family name usually house name and last name is Father name. Father and mother names are mentioned in the birth certificates but full name of child is not mentioned and is different from father’s full name due to the middle name of child is from mother’s father name. The mother of child did not retain her maiden name after marriage and her name contains only her first name and husband name. The panchayat and district registrar denied the request for issuing the birth certificate with full name saying that rule does not permit. The State of Kerala issues birth certificates with full name of child but in State of Maharashtra it is not permitted and issues birth certificates only with first name of child. We requires birth certificate with full name of the child mentioned for the purpose of emigration and passport. The school registers and Ration card contains full name of the child. Please advise to include the full name of child in birth certificate.

Can a insurance policy holder claim for the lapsed...

Can an insurance policy holder claim for refund of premium paid of a lapsed policy. He took an ulip policy with 1 lakh premium but due to some reason he could not continue it. He only paid one premium of 1 lakh and it been around 2yrs. Please give me details if it could be done..Thanks

Registration of Marriage under H.M Act Urgent please

My clients both are Hindu, and Bride is 28 years and Bride groom is 22 years, approach me for Registration of their marriage under Hindu Marriage Act, before the Marriage Officer only, they have not interest to perform their marriage prior in any Temple, my clients have interested to do before the marriage officer only.

I went to the Register office and enquired they told that prior notice should be compulsory later 30 days of submission of their application, then Marriage officer will do the Registration. then i asked application form but they dont have application.

Respected Sir, if any body have INTENDED TO DO MARRIAGE UNDER HINDU MARRIAGE ACT, 1955.

I am asking all forms with regards intended to marriage (I mean 30 days later the marriage officer shall do the register the marriage) and procedure please tell sir, thank you for all experts in advance, i am waiting for your valuable replies sir.

Law of Limitation for complaint to Bar council against lawye

1) Senior Citizen hired a young lawyer for fighting case in Mangalore District Court. This case was for disputing a probate of his fathers Will.

2) The case was judged and decreed after one year in October 2008. The lawyer did not attend the Court for fighting the case even once over a period of one year and the judgement went against the old man.

3) Old man wants to file a complaint in Karnataka Bar Council against this corrupt lawyer.



What is the Law of Limitation for filing a complaint in Bar Council in Bangalore against this lawyer for professional misconduct? Is it two years? And, does the counting start from the date of the judgement and decree?

Anand's Apology to Apex Court

Fearing more action, Anand says sorry to SC


Once a prominent criminal law practitioner and now stripped of his senior advocate designation after being convicted of trying to influence a prosecution witness in the infamous BMW hit-and-run case on the basis of a television sting operation, lawyer R K Anand has given up the fight to restore his honour, and apologised to the Supreme Court.

The tendering of apology and appealing for mercy by Anand came in response to a notice from the apex court to him on July 29 last year asking why the lenient punishment — banning him from practising in the Delhi High Court and its suborddinate courts for four months and a fine of Rs 2,000 — be not enhanced to make it commensurate with the gravity of his misconduct.

The SC had on July 29 said Anand’s offence was “grave” for which the punishment should be stringent than the “lenient” sentence given by the HC and had asked him to show cause why the punishment be not enhanced.

“The action of Anand in trying to suborn the court witness in a criminal trial was reprehensible enough but his conduct before the HC aggravates the matter manifold. He does not show any remorse for his gross misdemeanour and instead tries to take on the HC by defying its authority,” the Supreme Court had said while terming the punishment given to him by HC as “wholly inadequate and incommensurate to the seriousness of his
actions and conduct”.

Faced with the uneasy prospect of getting a higher punishment, Anand in his response tendered “sincere and unqualified apology” for all the acts alleged against him virtually accepting the guilt. He also withdrew insinuations against one of the high court judges who took the decision against him.

Anand said the infamy already inflicted on him through the HC and SC verdicts was punishment enough. The HC had convicted him on August 21, 2008.

Regd.Society-availing loan/Resolution/POA

Hi All,

I got an issue to be resolved.Solicit your expert advise.

A society registered under the Karnataka Society Act.It runs three educational institutions.The society approached a bank for a loan to construct a building in one of the institutions run by the society.

The society vide its resolution of the governing body authorized the Administrator of the institution[where building is constructed] to execute loan documents and to operate loan account in the bank.

My question is whether a POA to be executed in favour of the Administrator of the institution to act on behalf of the society? or a resolution of the governing body will suffice? Please advise

Registration of FIR

LAW NEWS:

The government has not taken any final decision on mandatory registration of FIRs and is awaiting the Supreme Court verdict in a case relating to the issue. “From time to time, views have been expressed regarding mandatory registration of FIRs and no progressively solution is envisaged".

LOGAN VIEWS:

Nanden’s Unique Identification Card Project entrusted by our Prime Minister (smart cards to every citizen) would surely facilitate in a big way to even get FIRs registered online doing away Red tapism in the Police Department. Government should take a step further even without the intervention of Supreme Court.

Members of Public can also make best use of the proposed KIOSKS in New Delhi (AAP KE DWAR) to register their complaints

Que.1.In Our Legal System the Ultimate Judgement in any Case whether it is Civil or Criminal is Jail, then why should anybody be afraid of Jail, Because Payroll system is also that supportive in India?

About Temporary injunction

Hello sir,

Question 1:

We are having a land in our village, as it has been sold out by our relative without our permission, so we took interim injunction order in our DISTRICT court on the site, we send the notices to all the occupants but a person had already registered the land to his daughter we didn't know this so we send a notice to this person but now his daughter approaches MANDAL court and she also took the interim injunction order by showing that fake registration so what to do now sir?

Question 2:


One more thing in other plot we are trying to build a house. While constructing the opposite person came with their men and charged on us , we gave a complaint regarding this in the police station, the opposition also gave a false complaint saying that we too attacked them.
Police took both the complaint. what is this sir how can they do that?
So we need help sir, even after giving complaint each day they are coming with 25 to 30 people and vacating us.
