Purchase of property

Dear Sirs,

One of my client intented to purchase two different properties. When I scrutinising the documents, I have got some clarifications.

a. First item of property and its larger extent was purchased by one Ramasamy during the year 1965. He settled the portion of the property to his Minor son Ramesh through his junior wife Latha in the year 1976. The settlor gives only life interest to his junior wife and his minor son, the absolute right goes to the male legal heirs (Grand sons of the Ramasamy) of his minor son Ramesh. The settlor Ramasamy died in the year 1978. His son Ramesh died in the year 1987 as unmarried. The said Ramesh got four married sisters. His mother Latha filed a suit against the Tahsildar, to declare that she is the only legal heir. The suit is decreed as prayed for in the year 2008. The said Latha sold the said property in favour of the present owner. Further the said Latha died in the year 2009. My clarification is that both the Mother and Son have got only life interest, then how she sold the property without obtaining signatures from the other legal heirs of the settlor. Is it valid sale transaction. I request the learned seniors advocates to guide me in this matter with suitable case laws.

b. Likewise, the second item of property and its larger extent was purchased by one Murugan during the year 1975. He died intestate in the year 1979 leaving behind his senior wife, junior wife, 2 sons and 2 daughters through his senior wife, 1 sons and 3 daughters through his junior wife. The said legal heirs partitioned their properties during the year 1983. Under the said partition F Schedule property was allotted to his Junior wife and her son for their life interest and their life time the property shall be goes his (son's) male heirs. The said died in the year 1987 as unmarried leaving behind his mother as his Class I legal representative. His mother filed a suit against the Tahsildar, to declare that she is the only legal heir. The suit is decreed as prayed for in the year 2007 and his mother sold the said property in favour of the present owner. Further she died in the year 2008. My clarification is that both the Mother and Son have got only life interest, then how she sold the pproperty. Is it valid sale transaction. I request the learned seniors advocates to guide me in this matter with case laws.

With Regards,

IN 2008 we done a agreement to sell the land to some other party, specifying in the agreement that a case is pending in high court & regigtry will be done done after the court judgement.no time duration is mention in agreement, agreement is on simple green paper & not notorized on the assurance of buying party verbally that he will settle the matter in two three month,
now the almost two & half years is lapsed & buying party did not taking interest in
deal, their intention is that to grab the land by just by paying half of the amount.
they are offering half amount now on registry & post dated cheque for balance amount which can be realise only after the highcourt judgement.

IN BETWEEN THE PERSON (THE SELLER)WHO DONE
THE AGREEMENT DIED IN AUG 2009 & LAND IS NOW TRANSFERED IN THE NAME OF THEIR LEGAL HEIR.

Pay Protection

Hello Friends,

I need your valueable advice on the below mentioned subject:-

I was in CISF (Central Industrial Security Force) and resigned on 3rd March 2006 (Wage revision was Due from 1.1.2006) and joined BEML LIMITED (a Govt Undertaking PSU under MInistry of Defence).

They protected my Salary in the old Scale (Here Wage Revision due from 1.1.2007).

In 2008 Central Govt. Announce the wage revision from 1.1.2006. I put up my application in BEML to protect my salary as per Last Drawn Salary, which i received from CISF on the basis of 6th Wage revision. BEML Mgmt informed me that they will protect my salary later. In Nov 2009 Govt declared PSU wage revision. Now they are saying you will not get the PSU wage revision and they will protect my last Drawn Salary from 1.1 2007 on Notional Basis and even we will not get the Arear for the 2006 as their was the difference of salary after wage revision in Central Govt. and PSU salary during 2006. They are telling you will be double benfited, if we will protect your salary from 1.1.2006 and again revise the same on 1.1.2007.

My Question:- I have resigned Central Govt in Feb 2006 (i.e after wage revision) and joined BEML FEB 2006 ( before wage Revision in PSU due on 1.1.2007). I want to Know whether i can get the pay protection from the date of my Joining (i.e 6th Feb 2006) and also can i get the PSU wage revision from 1.1. 2007 (it gives me double benefit).

Please guide me if any Law is their to protect the Last Drawn Salary. As they have already refused me to protect my salary from the date of my Joining in PSU.

Others, who joined from the same organisation (CISF) after 1.1.2007 has been protected as per their last Drawn salary. They also get the Arears for 2006 in CISF.

Regards

AJAY KUMAR "
