2nd Marriage

Hello there,

My Friend's father has got 2 wives. His father, firstly married my friend's mother's elder sister. As they were not blessed with any baby initially, his father married my friends' mother. This way these 2 sisters are married to one man, i.e his father. This was happened in 1970s.

13 years back my friend's father and mother both have expired and his other mother (his mother's elder sister) is alive.

Can my friend approach court for getting his part of property that his father left.
Is he eligible for getting his father's property. His knowingly has written most of his properties on his both sons. i.e. my friend and his brother (son of the other mother).

Please help us. His living mother and brother both abused him and said they are not going to give him anything from his father's property.

Thanks in advance.

Gangaram.

INDIAN PARTNERSHIP ACT

WE ARE A REGISTRED PARTNERSHIP FIRM WITH REGISTRAR OF FIRMS SINCE 1994. BUT ABOUT A YEAR BACK, A DISCREPENCY WAS FOUND AS THE NAME OF FIRM WAS MENTIONED AS AVS INDUSTRIES INSTEAD OF AVS SILVERPLATE & ADDRESS OF THE FIRM WAS MENTIONED AS THE RESIDENCE OF PARTNERS INSTEAD OF WORK PLACE IN THE REGN. CERTIFICATE.

SUBSEQUENTLY, THIS ERROR WAS RECTIFIED UNDER SECTION 64 B OF THE IPA ACT, WITH GREAT HASSELS.

NOW, KINDLY ADVISE WHETHER THIS RECTIFICATION BE APPLICABLE WITH RESTOSPECTIVE EFFECT OR NOT

THANKS & BEST REGARDS.

Fraud and Forgery case

Hi Friends,

One of my friend Sachin Hedau is been arrested and currently is in Judicial custody after policy custody.

He is arrested because one of his friends cheated him, Sachin Hedau was guarantor to his 2-3 car loans but car was not bought at all and money was directly paid to some fraud company.

Even, it is obsererved that Sachin's friend has forgered his ITR document and submited in bank and also Signature on few documents.

Hence, when bank came to know about this bank logged a forgery complaint against his friend and also Sachin Hedau.

Intially, Sachin got bail before arrest but that was cancelled by court and later he was taken to Police custody. Police has given a positive report that they have not found any thing at his residence and shop. But, Now he is under Judicial custody at Yerwada Jail.

I have few queries :-
1. How can Sachin Hedau prove that he was not involved in the fraud.
2. How can he proved that his friend forgered the document without his knowledge.
3. How can he prove that the actual Signature on the documents submitted in the bank does not match with his actual Signature.
4. Whether he can get a bail and If Yes, wht should be the approach of lawyer.
5.Now, if any persons wants to be a guarrantour for his bail, wht all liability will be on the person who is standing as a garantour.
6.Whether person who is standing as guarantour what all rules and regulation he will have to follow.
7. What all documents will be required by the person who wants to stand as a guarantour or bail.
8. Whether the guranatour will be liable for any fianacial re-payment of loans, if Sachin is been proved guilty and not in possition to pay the loan.

Thanks & Regards.

13- Transfer for benefit of unborn person.
Where, on a transfer of property, an interest therein is created for the benefit of a person not in existence at the date of the transfer, subject to a prior interest created by the same transfer, the interest created for the benefit of such person shall not take effect, unless it extends to the whole of the remaining interest of the transferor in the property.
