Labour and service related

Background :
The contract of employment has a clause which states that both the parties should serve a notice period of 30 days . It also states, that the employer has the option of sending the employee earlier by paying salary in lieu of notice.

Facts : The employee has given a notice to the employer by stating that he should be relieved " on or before" a particular date which is exactly 30 days from the resignation date.

The employer has however relieved him earlier by 8 days.

Can the employee claim the "salary in lieu of notice" clause and ask the employer to pay the same.

the critical thing is about the usage of the word " on or before " in the resignatino letter of the employee. Although the employee has used the word " on or before" he has mentioned the date which is exactly 30 days from the resignation date.

Can he claim the "salary in lieu of notice" benefit.

Are there any case laws supporting such a claim?

Marashtra Labour Welfare Fund Reply

My company established in November 2009 & we registered in Marashtra Labour Welfare fund in the Month of March 2010 Paid december Dues in March 2010 We receved letter from Bombay Welfare fund they wanted to produce following Details

Registration Licence Bombay shops & establishment act 2)

Certificate of incorporation 3) Muster Roll & Wages 4 ) Every June & December Payment Challn 5) Register of Unpaid Accumulation & fines

6) Record of Fine & Bones 03 -04 5 ) Record of Payment of Bonus & Fine

6) Balance Sheet along with schedule Trial Balance & General Ledger



We have just completed nine months we are not close 2009-10 Accounts & Trial Balance & balance Sheet & Also We are not maintan any muster Roll


Can please how to draft letter reply to marashtra Labour fune on the above matter & also give format of Drafting Letter & suggetion on above will be greatfull

tax exemption infrastructure projects

Dear Sirs,

The company is engaged interalia in road construction,buildings in an outside india(Overseas projects)
The questions is as follows:
1. Is thare any tax holiday/exemptions/sp rates for the infrastucture export companies.
2.Is there any custom duty exemption available for the import of used machinery and under what provisions.
3.Is there any special packages for the workers returning from the overseas projects-exemptions from the customs duty -limits for the personal items,easy money transfer system.

1.Company A has an entity in US and is a leading company in Consumer lending business. This company intends to start a payday lending business (say Company B) in UK. What are the various legal aspects that company A should be aware of to start the business in UK? Who will be the supervisory authority for the Company B in UK? And why?

Payday Loans are short-term loans which are typically for small loan amount and has a typical during of a payday (time difference between two pay dates) cycle.

"STEPS INVOLVED IN AUDIT PROCESS"

then first what kind of steps u can take?

i)what is your audit planning?

iii)In what way your verification will be?

Legal Rights

I & my friend had applied jointly a Flat in Greater Noida Scheme my friends was the 1st Applicant and I was the second Applicant. A flat has been allotted by Greater Noida Authority & the allotments letter was issued in the Name of 1st Applicant i.e My friends. It was mentioned on the Application form that all correspondence would be send to only 1st applicants. Now I want to know about legal rights on the flat both applicants will have the 50% each right or only 1st applicants have 100% rights. Pl confirm.
