Housing Soceity rights to sell its property..

Sir,

Can a registered society under Maharashtra Societies Act, 1960, sell out society property along-with building threon?

Please reply, waiting for you expert opinion ..!!

INSURANCE OF ESIC IS NOT VALID?

my father was an employe of NTC,GOVT OF INDIA UNDERTAKING, When he was on duty at factory premises he got a accident and getting pension from ESIC,
Latter on he given VRS and came out from factory, as per ESIC law's whom ever is getting PDB, he & his wife can avial medical benefit as long as they live.

In an emergency my father had gone a major operation for cancer in a private hospital, we incured a cost of arund Rs 1 lakh, & my father also expired.

When we submited a application for claiming the 1lakh from ESIC, They are saying they can not able give . since he his not taken the treetment from ESIC & They are not giving treetment to my mother also.

I kindly request any expert can assit us.

mutation not done

I have purchased a agriculture landed property in 1975 in AP by way of registered saled deed but did not take posession of land and also not mutated in revenue records like r.o.r and adangal. The legal heirs of seller were only enjoying the land, entries in revenue records and also passbooks and they again sold this land to third party in 2006. Now that I came to know and I am not having the original saledeed also with me. Can I approach court and claim my right over the property now? What is the best way to get back the property now? pl. suggest.

CAPITAL GAIN TAX

I AM HAVING COLLECTORS LAND IN MUMBAI UNDER THE LAESE DEED FOR 99 YERAS. MORE THAN 90% OF LAND IS SUBLEASED OR GIVEN TO TENANT THE SAID SUBLEASED AND TENANTS ARE HOLDING THEM FOR MORE THAN 20 YEARS SINCE ALL THE OCCUPANTS ARE DESIROUS TO GET THIS PROPERTY REDEVELOP, THE BUILDER HAS AGREED TO GIVE SPACE IN THE NEWLY CONSTRUCTED PREMISES AND TO LESSEE A LUMPSUM AMOUNT FOR ASSIGNING THE RIGHTS TO GET THE PROPERTY REDEVELOP + THE SPACE HOLD BY LESSEE HIMSELF.
MY QUESTION.
1.HOW THE VALUATION WILL BE DONE FOR CAPITAL GAIN TAX PURPOSE ?
2.ON WHAT AMOUNT THE CAPITAL GAIN TAX WILL BE APPLICABLE TO LESSEE WHO IS ASSIGNING THE RIGHTS.
3. THE AMOUNT RECEIVED IN LUMPSUM WILL BE TREATED AS LONG TERM CAPITAL OR OTHER INCOME?
4. SCOPE AVAILABLE FOR TAX PLANNING.

To Sell the Property

We have Ancestral Property situated at Tal-Devrukh and District-Ratnagiri. Now Seven persons including me are the joint owner of the property and we want to Sell our Ancestral Land. But one of our Grand Father whose name was mutated in 7X12 Extract 35 yrs ago who is no more now and whose name is not now in mutation entry but he was having some childrens. Whose name are also not mutated in Mutation Entry since last 35 yrs and this Grand father and his childrens since last 35 yrs where stay we dont know as he left our Village since last 35 yrs. We tried to find out his and his childrens address but we didnt find it.All the Seven persons including me whose name are now 7X12 Extract are ready to sell the property jointly.
Now as we want to sell the property during Search Report made by our Advocate he pointed out this defect so we dont know what to do.
We are really in need of money and we want to sell the ancestral property but due to this defect we are unable to sell the same. Anyhow we have to sell the property.

Agriculture Land acquisition

Sir, We have purchase agriculture land from my uncle in 1992 through just Rs.10 stamp paper, but till date we have not prepared 7-12 8A documents in my fathers name now my uncles's son demanding that land on his name and he has done 7-12 8A documest in his name,in the documents evidence we have only stamp paper on which sing of my uncle (now he is expired)and witness.what should we do to get this land on our name? pls help me

E1 sales / purchase

In E1 Sales

1. Should the first invoice (i.e)invoice of the original seller must contain a word as E1 Sale anywhere?
Whether the delivery address in this invoice must be first buyers address or the subsequent buyer address?

2. When B purchase from A for rate of Rs. 100/- Can B raise invoice to C for Rs. 105/- including his profit or the rate should be the same as A?
If B can, should he have to pay tax for the difference amount- On what basis CST or Local Vat rates?
If B doesn't have to pay tax wont there be any question raised by the Govt. regarding revenue loss to Govt.

3. From this site I understand that the delivery address in the GR/LR copy should be the original buyer and it should be duly
endoresed in favor of the subsequent buyer by the original buyer. But my doubt is that finaly the freight will be paid by the subsequent buyer. So in the carriers receipt or the carriers freight invoice whose address should be mentioned- the first buyer or the subsequent buyer?
