UK/NRI Property Investors

Dear Sirs

I would very much value your expert knowledge and guidance on the following matter:

We are a group of UK investors who trustingly invested in a new property development project in Navi Mumbai in 2009. However, due to irreconceivable differences between the 2 partners in 2010, the project did not go ahead and all investors were told that their monies would be returned in full plus 10% interest by December 2010. This has not happened and we are all having difficulties in reaching either of the partners and getting our monies back.

We want to know where we stand legally and what are out options in getting our money back.

Your advice and guidance is greatly appreciated.

unregistered development agreement

my client is a developer, wants to enter unregistered development agreement with land owner by giving some amount as good will. land owner kept land documents in bank and he owes some amount to bank. the land owner says that he will remit the loan amount to bank from the amount received from developer and selling his share in the developed property. can a developer can enter in to such transaction or not , if yes what is the procedure or steps to be followed.

Sell of Non - Agri Land

A group of friends purchased a agricultural land in the name of one of the agriculturist friend as pruchase of agri. land should be agriculturist. The contribtuion was equal when purchased. Subsequently, the land was converted in to non-agricultrue and they would like to sell it. I have following querry for the above:
1. If land is sold then is it possible for purchaser to give the amount equally to all memebrs by way of cheque. What are the implications on getting the amount. What will be the tax implications.

2. What will be the stamp duty under the Bombay Stamp Act when sold.

3. Any other solution to sell the land.

how to obtain title for land in possession paying taxes till date

we are in possession of a 375sqyds of land in hyderabad, paying muncipal taxes from 35years to till date .the property tax is paid in the name of my mother. we dont have any document, except property tax payment , current bills , ration ,voter card.

cooperative housing society - taxi permit car parking prohibition if any

is there is any prohibition in parking of T permit car (owned by the member) in society premises. Owner has a business of car rental and park only one car like other members. society is not permitting the parking,Member does not have any other car than this T permit. pl guide the rule.

Recently in our organisation promotions for 2 posts were conducted on the basis of seniority cum merit. I am second in seniority. the management has given promotion to number 3 in seniority by skipping me. there are no remarks in my carrier. pl advice me how to proceed and defination for seniority cum merit.

Revocable Living Trust

Hi,

Can you please tell me:

1) Is a living trust drafted in India also valid abroad and vice versa? For instance can an NRI with assets both in India and abroads draft a living trust in India that would be valid for the foreign cuntry as well?

2) If a trust was drafted abroad can it be modified/revised in India by a licensed lawyer?

3) What are the average costs involved with creating a trust which involves only cash assets - no property/no other assets - only bank investments and a retirement account for a single/unmarried person?

4) How do I locate a reliable lawyer in Hyderabad - someone who is professional and confidential?

indirect tax-Central Excise/service Tax

I wish to have some case laws of various courts namely, Tribunal, High Courts or Supreme Court on the issue that Modvat/Cenvat Credit is admissible even for the period prior to registration if duty or service tax is payable.
Kindly help.
