Contempt Of Court Act, 1971.

Section 1
Comments
(ii) Proceedings of contempt are summary in nature and also are sui generis; Golcha Advertising Agency v. The State of Maharashtra, (1990) 2 Bom CR 262 (Bom).

Query : What do u mean by summary in nature & sui generis ? with the help of a example(S).

Section 2 (b) "Civil contempt" means willful disobedience to any judgement, decree, direction, order, writ or other process of a court or willful breach of an undertaking given to a court.

Query : So can we say that oath take before the court or any magistrate whether in the courtroom were proceedings are going on & if the person who has take the oath as per the act act are also follows under the same context which is (undertaking given to a court) because there is no defination of "undertaking" ? Also can we say that while giving the oral evidence & standing in the witness box & take the oath that what will be said by me will be true & nothing other else while keeping the hand on the gita. & if if says wrong than he/she is laible for (willful breach of an undertaking given to a court) ?

Any APEX COURT Judgement OR correct me if i am wrong.

high rent raise

hi, we're staying in chennai for 10 yrs in a single bd room flat and our rent was rs. 2200 when moving in and an increase of 10% every 3 yrs was made until jan 2009 (rent was increased from 3500 to 5k plus maint: 300) and again this jan 2011 increased by rs. 1500 (5k to 6500 plus maint: rs. 500).
the same rs.1500 is raised for the other(x5) 2 bed room flats in the building. ours is the only single-bed room in the building and landlord declined a difference in raise when approached and said you can accept or shift. and the next rs. 1500 raise will be in Jan 2013.
the building is 20 yrs or more old and no major repairs done.

there was no lease agreement or any docs signed on between us and only hand-written paper slips given as monthly rent slips - i have always paid in cash up-to-date.
she's an arrogant unapproachable business landlady and says shift for any thing at all.
My query:
1) Is this kinda raise (roughly 25% in 2009) legal and can i sue her?
2) will i have to shift if she asks me to when i sue her and?
3)how expensive will expert help be, in chennai and whos the best around here in this field?

Tax pay for salaried person

sir,
due to change of job i could not pay proper tax for the financial year 2010-11through my offices ,now i want to pay the tax through bank ,but to pay tax i am facing difficulty-such as -for challan no-280-i)what will be assessment year ii)type of payment is it advance tax or self assessment.

i shall be highly obliged if you would provide me the answer.

No Name in the Cause list Of Hon'ble HC,Hyderabad inspite of direction by the Hon'ble Court

Sir,
I am a party-in-person at present I have filed a Contempt Application in APAT,Hyderabad which is in final stage. As such the respondents in CA (Original Application No.4042/2006) have filed a WP in the Hon\'ble HC,Hyderabad , suppressing the facts and got orders in WPMP against me The Hon\'ble HC suspend the APAT,Hyderabad orders. At this moment I have filed a WVMP and and vacated the previous orders of the HC In WPM But the HC directed me to approach HC for final hearing on 14-03-2011. today I have checked cause list but my name is not there.

Therefore, the interim suspension granted on 20.12.2010 in W.P.M.P. No.38896 of 2010 shall stand modified and the vacate stay petitioner’s status existing as of now as Deputy Executive Engineer shall be continued.

W.V.M.P. is ordered accordingly.

My CA has been posted for further disposal on 16-03-2011 by the APAT,Hyderabad,
Why my name is not there in Hon\'HC,Hyd cause list which is supposed to be there in.
Kindly suggest me on the above issue, it a burning problem for me because I have been struggling for this since 1983. I have been given all promotions (1) DM III Grade (2) DM II Gr. (3) DM I Gr. and (4) Dy.Executive Engineer w.e.f 2002 and as per OA filed in the year 1998, Wp filed in the year 2003 and OA in 2006

BAR COUNCIL OF INDIA ENROLMENT

I have come to know that UPPER age limit has been fixed for LLB admission .

Although, some universities are STILL giving admission without upper age limit, BAR COUNCIL of India will not enrol such senior students due to age limit .

Kindly give your opinion, should one take admission in 5 YEAR LLBCOURSE at age around 35-40 when it is doubtful that BAR COUNCIL OF INDIA may not enrol such students.

wealth tax act 1957

Respected sir, my father is a govt. servant. We have a residential house in our city and about 2 acres land in our village. some money is in bank. Except that we have nothing else.
I want to ask that according to wealth tax act 1957, what is our property? Whether the house will be exempted and village land will be excluded from calculation?
Actually i am calculating it for determining whether i am in creamy layer or not( 20 lakhs exemption limit) ?
Kindly tell my property.

CEILING ON LAND

Sir/Madam,

My grandfather bought an agri land(rural) of 10 acres from his own money from a landlord(he had land excess of ceiling limit) in 1956s.
My grandfather made partition and gave it to my father in 1971.
My grandfather and father are no more now.
But recently, i have gotten 2 notices from Land Reform Department of Tamil Nadu.
I came to know that my grandfather bought this ceiling land just before the ceiling act on rural land.

Now my question is:-
1. Shall the government take over this land or not now?
2. If take over will be done, what is remedy for me?
