Work Permit

Dear Sir/Madam,
I am a citizen of bangladeshi, i married in India and my wife is indian and i applied of indian citizenship and permanent resident now i am staying in india permanently. Now i got a offer letter from one company but in their offer letter shows valid work permit required if applicable. Thats why i contact with one lawyer firm which is in delhi for work permit from MHA if required . After one month they told me they went to MHA and concern person of MHA told to lawyer MHA send Long term Visa to state govt and LTV is entitled for work. So i donot need separate permission for work. Please would like to know me LTV is entitled for work? or lawyer did not done his duties?

TRANSFER OF PROPERTY ACT

We has been executed an agreement to sale and in that agreement to sale the Seller allready handed over us(Purchaser) the possession along with Part consideration. the required stamp duty is paid for the said agreement and thereafter it was Registered.

After that one 3rd party file an suit for recovery of money on the saller & in that suit he has file attachment before judgment application,

Is there any judgment that the Agreement to sale would be consider as sale Deed or is there any judgment on whose basis the said application of Attachment before Judgment application would be rejected.

drawback


R/Sir,

do you have any clauses/ solution to track drawback amount . Actually we export readymade garment in march 2010 to spain, but the drawback amount is not credited in our a/c till now, so what should we do now.

Difference/Procedure between Labour Court & Industrial Court

I want to knw what is the difference between Labour Court & Industrial Court, which matters should be filed before Industrial Court & Labour Court and who can file the same.
What do you mean by Labour, Workman, Employee

498a+406+34 now DV act 2005

Hi All,

I need your help from your past Experiences faced related to DV act 2005.

Brief History

• 498a/406/34---Registered in CAW Nanak Pura but under investigation
• 7 Days notice already grant by court before arrest.
• Both FIL and Wife are GOVT Servant.
• Not Living since Nov 2009
• 10 months of Marriage, 8 month spend in Rented Accommodations near to wife office.
• DV Story is same as mentioned in the 498a FIR.
• Main Point: FIL has given 2 cheque 21000/41000 to me and claiming that these are a part of DOWRY in the DV Notice whereas She has admitted in the Stridhan List that all these are gifts to buy Engagement ring/Clothes.

1. Complaint Filled as per the rule 2 (B) of Protection of Women from Domestic Violence rules , 2006 read with Sec 5 of DV act 2005..

2. Protection orders under section 18 as more specific mentioned in the application u/sec 12 DV act.

3. Residence orders under section 19 as more specific mentioned in the application u/sec 12 DV act.

4. Monetary Relief under section 20 as more specific mentioned in the application u/sec 12 DV act.

A. Medical Expenses: 10000 PM
B. Food, Clothes, Medications and other necessities : 10000 PM
C. Household Expenses 20000 PM
D. She is working and claims that Rs. 35000 Salary and my 1 Lac.

5. Compensation orders under section 22 as more specific mentioned in the application u/sec 12 DV act.

6. Damages for the injuries including mental torture and emotional distress caused by the acts of DV committed by the respondent amounting to Rs. 20 Lac

7. Interim and ex-parte orders under Sec 23 : Not sell the property which was in the named of my Mother and Brother.

In case of resulting company issue shares to the shareholders of demerged company than in that case what formalities to be done for ROC filing i.e. what ROC forms to be filed with ROC MCA for allotment of shares to the shareholders of demerged company.

SECTION 84 OF IPC APPLICABLE TO NDPS ACT


A person is falsely implicated by Narcotic Control Bureau {NCB}in a Conspiracy case involving commercial quantity for procurement of Contraband Drugs.

The Said accused is suffering from Paranoid Schizophrenia [unsound mind] since 2008 as per medical records. the incident has taken place in the month of JULY 2009

there are 2 issues

Is IPC {general exceptions}applicable to NDPS ACT u/s 84 of IPC which says that nothing is an offence for a person of unsound mind.

As far as i have done my research IPC is applicable to all the laws except for special law and Local Law.

NDPS is not a special law, the same is obtained under RTI.

I want to make sure that section 84 is applicable to NDPS ACT and not just for offences under IPC.
