Hello Advocates,
I am a IT professional and I am working in Bangalore, I have a issue with my home constructed by my dad. On 02.02.2011 my mom was cheated by some local culprits and took sign on our home sale deed, my mom was told that as my father is dead the property has to be transferred to her name and has took her to sub registrar and took sign on sale deed my mom is less educated and she don’t know all this registration work and believed them and signed where they told. I was away from home on a business and we came to know about this when that guy came to home saying this is my home and your mom has sold me. My mom also got to know on that day that they have cheated. We gave complaint to the police and police dint react much and they told you have to settle this I the court and backed out from the case. My Father has written a will that after his death the property should be under our uncle and he cannot sell or lease it and we can be in the home under his supervision. After his death the property will come to me and my mother right. So we filed a case in local court in 2011 and the hearing was going on and our lawyer was telling that the will is enough to get our property back and the case will be in favour of us. But a week back we came to know that the case is disposed as our lawyer has not attended the case and he has not at all submitted the will and we also came to know that he has collaborated with the opposition party and cheated us and he has destroyed the original will given to him. Now we have contacted one more lawyer who is very well known to our family and he himself has made the will for my dad. He says not to worry we can appeal in the court and we can present the will and we can fight in the court. But all our family members are worried a lot. We don’t have any place to leave then that home what if they come and push us from the home. I am not in India currently I am worried what will happen to my family out there. Our lawyer tells not to worry but how can I be without worrying. My worry is if our previous lawyer has not submitted the will till now will court accepts the will if we present now. And how strong the certified will can be used to get our property back.
Any suggestions will be helpful to relieve my worries .
Thank you,
Lohith

Hi All,
Learned Experts of this Forum.
I and my wife have filed 13 B of HMA and the court has given us the June as the date of hearing.
My questions are more of academics in nature:
1. My wife is trying to contact me via What'sapp and Facebook and other social medium states and pretending to reconcile the marriage.
2. I haven't responded to her request till date, I am pretending that I haven't received any request from her.
3. She may to court and say I want my husband back.
4. What should I have to do. I have no interest in her and the trust is almost broken and I believe we will not be happy even If I take a decision of living together and carrying the relationship.
5. I have all proofs of her curelty and adultry and in-laws arrogance in defending their daughter is correct in what ever she does.
6. Probably, she may come and take the MCD or she may dodge this case for long.
7. What options are left out to me post this as I filed RCR she was the one who pressed for divorce with settlement and we both filed the case and she is one who is creating all drama. Will this act amounts to cruelty on husband, filing MCD and again telling I want my husband back?
Please suggest
One of my client wrongly deducted TDS as 1% instead of 2% for the FY 2012-2013 as my client is partnership firm 2% is correct. The contract party has filed the IT Return for the FY 2012-2013. Income Tax Department sent notice for short deduction for 1%. Please give me suggestion on my client point of view whether tds to be deducted and paid.
The contractor is not accepting to deduct TDS now as he is claiming that already he has paid Self Assessment Tax and filed the IT Return for AY 2013-2014.

Respected Sir/mam,
I was the incharge of one of the institutes for a particular area. They did not pay me 2 months salary, so I used a certain amount of fund for myself from the institute's collection. I also asked them to adjust it from my salary which was due. They forced me to write a note stating that I have taken that amount in a blank paper. They adjusted the expenses that I incurred for the company purpose as well in that particular amount, even the phone bill. I requested them but instead they sacked me with proper notice. Now they are threatening me with legal consequences. They are telling me to pay the amount first and then they would pay my salary. They did not even give me a proper offer letter and even did not take any of my documents. The amount that I have used is far less then the amount I am supposed to get from them.
Please help me with your valuable advice. Whom can I appeal to?
