Dear Sir,
I am a accused under section 420 and 120B, now after 5 years the case is in evidence stage, the Megistrate is purposely not allowing the complainant to give evidence, he is just making us to sit int he court hall for the whole day and in the evening at 5 pm he is giving another date. We are fed up that nothing is working out in the court, simply waste of our time. Kindly advise me what shall we do now. In the other hand the complainant is not ready for any kind of out of court settlement, he want only to contest the case.

Some people came together and registered a Co-Operative Hsg. Soc. and purchased plot in the name of society by registered Sale Deed. At the time of starting construction, society has executed an agreement with the members and subsequently handed over the possession of flats to the members of the society. However both the agreement and possession receipt were not registered in any manner.Plot, plan sanction, commencement and completion certificate all documents are clear.
Now one of the member/flat owner is trying to Sell his flat.
The purchaser has raised the query regarding non payment of stamp duty by the owner of the flat at the time of agreement and possession, with the society.Bank is also ready to sanction the loan subject to consent of Society.
Now the question is whether the said property (flat) can be said as clear title to purchase?
Pl give opinion of the issue.
Dear All Learned Experts,
I have a question below:
Can a company insert certain condition/Clause in appointment letter that after leaving/quitting the company, the employee cannot join the competitor company for a period of 6 months or so. Whether this condition is valid in the appointment letter? How far this clause is valid in the appointment letter?
Request to Ld. Advocates to kindly reply.
Regards,
Sam
Dear Sir,
Magistrate order to registered case (IPC 294(B),341,419,468,471, 506(1) on 29/03/2012 received by local police station. But, Inspector of Police registered on 11/04/2012. May I take action against inspector of police not to register case on time. And further charge sheet only (294(B), 341, 506(1) dated 16/10/2012, But STC dated 27/02/2013. May I ask for reason for delay to submit chargesheet to court. Both for same case. what is the procedure to approach court? what petition we have to file at court? which court?
Plaintiff failed to prove his case prima facie. Whether the defendant requires to prove his defense ?
Complainant filed his balance sheet and proffit and loss account with his complaint,
in which he showed advance of money to the accused. But no statement of account had been filed on record. Also the income shown in P & L Account and income shown in his I.T. Return are not same.
Therefore
Whether the balance sheet and profit and loss Account cant be considered for existence of legally enforceable debt in absence of books of account ?
Can 6 months cooling period can be waved off when 125 was in the same court?
Hello
From last 2 yrs I’m fighting my crpc 125 case & DV case in another court (two cases… nether divorce not RCR ). 3 months back before final judgment in 125 case, Honorable Jude has asked both to go for settlement. After 20 minutes of negotiation, I agreed for 7 lakhs on final separation / divorce
We both have signed ‘Mutual pursy’ with full and final, with condition of 4 lakh on filing date of 13 B petition.
And rest 3 lakhs on last date, when the she will withdrawn DV and 125 case when I will submit second DD of 3 lakh.
As per decided I have submitted the first DD of 3 lakh on 10 March 14 and we both sign 13 B petition. Judge have given the date of 16 June 14 without saying anything .
I have not courage to ask judge about that What will happen on 16 June 14.
My new Lawyer told my that judge might be waved off 3 months as your 125 was in same case. I really wondered how Judge has reduce 6 months cooling period ?
Now my question is
1.What will happen on 16 June 14.?
2.Is it possible to waved of 6 months cooling period to 3 months ? even if not divorce or RCR case filed from either side?
3.Should I carry rest 3 lakh DD on the 16 June (after 3 months). Or I need to submit it after 6 months
4.What are the steps ? Fist withdrawn of 125 / DV ………………. then final signature on 13 B petition (second motion)……… or they will just took my 3 lakh DD and give me next date ?
5.What will happen if she not came to court on 16 June 2014.
Sirs / madam Please resolved me
