Validity of a will by a member of hindu undivided joint inherited immovable property

The brief fact of the problem is;

An undivided Hindu family consisting of 09 (nine) members, which include two sisters, inherited an immovable property measuring 01 Bigha (one bigha)(approx)in the State of Assam and after death of their both parents the aforesaid land was mutated in the name of all legal heirs.

One of the male unmarried legal heir of the aforesaid undivided family died before partitioned of their aforesaid inherited landed property.

That before his death he executed a Registered "WILL", which is his last testament. And in the aforesaid "WILL", he mentioned that, after his death his proportionate share of the aforesaid inherited landed property shall be equally entitled by his two sisters.

Now all of the legal heirs are decided to partition their aforesaid inherited property equally.

Now my question is that,

a) Whether the aforesaid "WILL" can be legally enforceable in the eye of law and the executor of such "WILL" can obtain probate ?

b) Whether the aforesaid two sisters of the deceased can be equally entitled deceased share as per the WILL & last testament of the deceased of their inherited landed property ?

C) If so, under what provision of law ?

d) Whether two sisters of the deceased entitled any benefits from the aforesaid WILL & last testament of the deceased ?

e) if possible, please suggest me any citations in this regard.

Living home distribution


My name is abid. We are muslim family. We have home at native place build by grandfather. He is nomore. My grandmother also expired. My father has one brother and one sister. They are also expired. My father and cousin brother(son of fathers brother) purchased share of my auntie(fathers sister). We live in common bunglow which is in 4000 square feet land. There are 10 rooms. 5 room each. My cousin want more vacant land around bunglow. He is criminal in nature. He is telling to my father if he will not get property distribute d according to him, then he will trouble us. I want property distribution from court. Please suggest me how to proceed

Tds on flat purchased from nri

Hi,

Last year (Aug 2013) I have purchased a flat from an NRI via his GPA holder (his father). At the time of purchase he didn't provide PAN number as he has no PAN number with him. But he told that he has already given an application for PAN to Income tax department. However he has not received the PAN yet. so my query is

(1) What are the option available to me if he doesn't provide PAN. He has already given TDS (1% of sale price) money to me.

(2) Can I submit TDS using GPA holder's PAN number ?

(3) What next step should I take to safe guard my interest.

who has a right in property for sell it

Dear Experts.
In state of gujarat there is a one house property.
Real owner of house was Mr. A (MALE-DIED) and
WIFE OF MR.A WAS ALSO DIED.
Mr. A and his wife has a two daughters for example B&C, both are married.
B has a one son minor.
Now daughter B also died.
Now the question is who has a right in house property of Mr.A

Relieving letter

Hi,

Sub- Relieving letter

I was employee of Microland Ltd. I resigned from that comany and didn't serve the notice period negotiated with my manager but he didn't agree to buyout policy.

They marked me absconding in there record and not provided relieving and experience letter.

Please help.

Notice from electricity enforcement department

Dear all,

History of my case.

I live in a DDA society in delhi.
On 16-May-2014, a fire broke out in common room where building's electricity meters were installed.
Our neighbours logged a complaint to electricity dept and it settled down.
When i receive bill of month of may, there was a notice attached about correction in bill and the bill was served on average consumption of last six months. To my surpise i found that in our meter reading jumped more than 1 lakh units. Then i linked this jump to the fire incident as root cause of it.

I logged a complaint to electricity dept about my meter complaint for jump. They visited my premises and replaced the meter and seized the origional meter after taking photographs of all eletricity gadgets of my house and i am being told to appear at meter testing department in Aug where they will judge meter tempering or other meter problems in front of me.

I have never been to such legal complications and seek your advice to be prepared before appearing to the testing lab and how can i safeguard my interests from any panelty.

Learned experts,
My friends has been roped in 498A, 307 etc., and during examination in chief of the complainant wife, she took out some photos from her bag and produced, weeping aloud. The photos show some bruised wounds on her thigh etc. My friend's counsel resisted belated production; and now the cross is deferred for filing objection to application filed by the prosecution u/s 231 cr.p.c. for production of photos now.

Can you pl. guide me and citations if any will be gratefully acnowledged.

Car accident

dear sir i already mentioned my car accident case . on 22 july i went to district court to attend hearing. that only attendance was there and my lawyer told me that case are reopened till now. judge given me next date on 5 aug for counter file. my lawyer are saying may be next to next hearing we will come to know that case is going to be reopen or not.
sir i want to know if district court allow to reopen this case after 3 years. is there any provision or procedure to take stay on district court judgement from high court?

a short brief of my case:

i made an accident in mar 2011 in which a 9 year girl's right leg 's lower part amputated. i accepted my mistake in session court and court imposed me a fine of rs 2500 which i paid and case closed .i was in the position of having license, car insurance, no drunken driving, no rush driving even i took the girl to the hospital.that time i tried to make compromise with opposite party but he was not ready for written agreement , no cheque,no demand draft only hard cash he was asking so that i could not keep any record .but now after almost 3 year her father filed a petition to reopen the case in district court
