As per my clients employment policy they have a notice period of 2 months.
Now an employee found guilty of wrong doing was to be terminated but just before that he sent his resignation on email stating he has resigned due to personal reasons.
My client is now obliged to pay him notice pay or ask him to serve notice pay both which is not acceptable.
Hence I would like to know if a person who has resigned then can he be terminated after that without any legal complications.
If there are any legal complications what are they as the employee is asking the company to provide an acceptance of his resignation.
My client has a manufacturing set up.

Dear Sir,
My wife filed for divorce, sec 125 and dv act against me. The DV act was dismissed two times as they did not turned up. After the two times they again filed the same case and again this time they are not turning up. Now finally the judge had ordered colosure of their evidence and have given me the chance to submit my evidence.
The divorce case was filed and i was given an interim order to meet my child on a fixed date in the court but my wife never brought the child to the court on the pretext that the child is ill. Then finally on the third date she withdraw the divorce case and thus the order that was given for meeting the child to me was cancelled. Then i filed section 9 and section 26. The judge had granted expartie in section 9 in my favour while he had not entertained section 26. I have a daughter of 4 years as of now. But he had ordered that i can meet my daughter once in a month.
Now suddenly the wife and her parents had left the city with no information as to where they had gone. Can you please tell me what i should do so as to make them bring my daughter back so that i can meet her.

respected sirs,
wife got an exparte final order of maintenance.i have given some of the interim also.in middle of the case i have dropped due to distance of the court.but one and half year ago i got conjugal rights decree.now
1)can i stop her execution of maintenance decree by showing conjugal rights decree? or
2)do i need to file seperate execution of conjugal rights decree?here can i defend her maintenance?

Kindly inform in which court unauthorised construction case which is happening in East Delhi will be filed.
we have already complained to Police and EMCD but construction has not stopped.
Normally how many dates court takes to stop the illegal construction.

Sec 2A(3) of ID Act dealing with cases of termination by which petition to be filed before Labour Court within 3 years of termination. is coming effect from 15.9.2010. The Labour Court Judge says that this amendment is retrospective and took the stand termination effected before 15.9.10 has to be filed within 3 years. say for example if an employee was terminated on 10.1.2007 he must file application before the Labour Court within 9.1.2010.Whereas Trade Union Representatives argued that the amendment in Sec 2A(3) is prospective only and it covers termination effected after 15.9.10.Kindly furnish citations for application of amendment in Sec 2A(3) of ID Act propectively
