Complain against apartment builder

Builder has delayed completion of 400+ apartment project in Guwahati by 4+ years. Though possession have been given to about 80% of the clients and about 80 families have started leaving in the apartments the builder is yet to complete/take up construction of common amenities.
Completion/occupation certificates have not been provided and electricity connection to individual flats are temporary on which they are charging for electricity consumed by flat owners.
They have collected one year society/maintenance charges from the clients before giving possession. Now they are asking for additional maintenance fee @ Rs. 2/SqFT/month from the resident flat owners saying that their one year maintenance is over on 31-Dec-14.
The flat owners have formed a society with standard bye laws and got it registered. It has 75 members at present. The society is writing letters to the builder on the issues. But the builder is not responding to any of the letters.
These are clear case of violations of Assam Apartment (Construction & transfer) Act 2006 and Rules thereof. Their actions can also be termed as misappropriation of our money and cheating.
Kindly suggest what will be the best course of action for the flat owners and the society.

Is there any receipt of court fee paid to obtain succession certificate?

I have a query regarding payment process of court fee to obtain succession certificate. Is it like pay the money to buy equivalent amount of stamp paper from stamp vendors and submit that stamp paper in court and get the succession certificate? Is there any kind of receipt provided which proves that the stamp duty is paid? I have been asked by my lawyer to give him the money, am concerned whether I will get a proof of the money paid or not.

Execution petition

the matter is that there was a compromise arrived at between the parties for partition wherein there was a staircase which comes under the portion of defendant and it was settled that when the ground floor portion will get vacated and when the plaintiff will get his portion vacated he will construct his own staircase. till date he is using staircase which is in the portion of the defendatn. now his portion is gong to be vacated and the defendant is filing the execution petition for directing the plaintiff to get constructed his own staircase.

the question is that do we need to implead MCD as a party?

I need the judgment regarding this if i dont implead the mcd a party and its the work of court to direct the plaintiff to construct his own staircase and is the duty of plaintiff to get the permission from MCD and get the sanction plan.

Respected Sir,

I have engaged with a girl on 6th December 2014, at New Delhi at girl hoouse, in simple cermony i.e. called Roka in punjabi, there are 1o persons from my side and 7 person from girl side, We give to the girl One set of earning Tops costing about Rs.17000/- and 11000/- as cash and one chunni, dry fruit tokri costing Rs.3000/- and a sweets box. The girls parents gives 2100/- to boy and Rs.1100/- to each one from boy side equal toRs. 9900/- and five sweets box and one fruit tokra and small thali of dry fruits.

Girls and boy exchanged phone numbers and from the next day they start talking and one 16th DEc. they watched movies in Connaught place.

Now from 17th DEc. girl start ignoring me, whenever I call her she say or message after few hours that I was busy, I try to meet her but everytime she say something which is not acceptable.

Now she is demanding a gift of diamond bracelet costing Rs.75000/- {no proof}, she
send me message dont go for roses be green go for diamond this valentine day.

Before marriage ceremony I mailed her that I wants simple marriage whether it is court marriage or marriage in mandir without dowry because what we save that will be helpful for our future life.

Next day she reply the mail that every thing will be done in simple way.

Date was fixed for marriage april 22, 2015.

Now she is avoiding me and I want to brake this marriage, because I think its difficult to be in relationship with her attitude.

Can I brake it, pl. reply.
can girl or her parents take any legal action which can put me or my parents behind bar.

Non probate will

my father in law has 4 daughters, of which my wife is second. Before his death in December, 1997, he had written a will in which he has mentioned that a property (immovable)in Chennai will be shared between his 3rd and 4th daughters after the demise of his wife - his wife, till her death can't sell or mortgage or demolish the property. this will was written in July, 1994 when he was suffering from acute cancer and was under chemotherapy. the beneficiaries of the will (wife, 3rd and 4th daughters) were the only person who were available while executing the will. The other 2 daughters were married and settled elsewhere. This will is still not probate and 1st and 2nd daughters are aware of such a will only a year back. The 1st and 2nd daughters feel that the other 3 beneficiaries influenced the executor (father) to write the will in their names since these 2 were not present at that time. Can this be considered as a death bed will or an influenced will. Is there any scope for us to contest the will. what is the possibility of the 1st and 2nd daughter to get a share of the property.

Purchase of appartment

Sir, can i buy pent house? one of the builder constructed the apprtment in our place, land is A katha and he has taken permission/ approval plan for ground and 3 floors, they have constructed pent house at 4th floor, for pent house no plan or permission, he is telling after some time we need to pay betterment charges for regularising the flat, and bank loan also availble, my question is in future any legal problem will arise? in future can sell the pent house to other? please suggest

My father had bought a land 20 yrs back and now he is expired. he did not create any will / property

Transfer of flat

Our father is no more and there is a flat in his name in Mumbai. We are 4 siblings A,B,C,D ( C and D are nominees)and thus each one is 25% co owner of the flat. The flat lies vacant since 7 years and now D wishes to occupy the flat.

A and B want to relinquish their share in favour D making him 75% co owner,but C neither wants to sell or buy from D to give him clear title of the flat, and threatens not to allow D to stay there.

Can D stay in the flat with 75% ownership title or can C create a problem?
Is there a way to bypass an uncooperative C,and let society transfer the names in 25-75 ratio?
