Hi
I am going to make a sale on a 24months EMI & would like to enter into an agreement with a party.
Could some advice me on the type of agreement to be made & may I get a draft of such an agreement.

A builder promised to make showroom in a mall and took money from us.
He entered in an agreement to offer possession in 20 months in may 2009.
He kept dilly dallying for several years.
We filed a consumer case as the purchaser is in definition of consumer and it is a continuous cause of action as the floor sold to us is still not constructed.
They were three director and one of the director signed the agreement.
In 2012 they dissmissed the director.
Can this builder file a suit against me for delcaration for agreement as null and void ?

My client, an Engineering Contractor, office based in Mumbai had undertaken engineering contract work for a company in Goa. After completion of the work my client raised an Invoice for X amount, the company paid my client part payment of Y amount, now the balance due Z (X-Y) is still pending, and yet to be received by my client.
My client has a copy of Quotation, Work/Purchase Order, Invoice and part payment details. 3 Legal notices have already been sent to the company by my client, but due to their dilly dallying tactics there has been a sum of interest accrued on the Invoice amount (my client has charged 3.5% interest on the Invoice amount per month). The company in Goa replied to the notice in negative dated 22/07/2014.
On the Invoice raised by my client there is a Note/clause mentioned which read as "Subject to Mumbai jurisdiction only".
Therefore I would like to request your goodself to offer your kind and generous advise
:
1. Can a Work/Purchase Order be considered as an Agreement according to Indian Contract Act?
2. Under which Act and Section of Law the suit can be filed?
3. Does Goa court has jurisdiction to entertain the suit?
4. Interest rate on the balance due amount charged by my client is 3.5% per month, is it ok? Or should something other percentage be charged?
5. What is the time period in filing the suit, after the reply of the company in Goa dated 22/07/2014?

My father has a mediclaim policy with National Insurance since 2008..He made a claim only once in 2012 for Kidney stones..The claim was settled as per our satisfaction..Now a few days back he was diagnosed with Glaucoma and had to be operated..He has not even recovered and these Insurance guys have rejected the claim saying : Once the Laser surgery was claimed (the one for Kidney stones) and so another laser one can't be claimed..?? They say that Cataract is covered but Glaucoma isn't covered because it is under Lasik Surgery which is a cosmetic Surgery ??..But it is not mentioned anywhere on the Entire Policy that such an exclusion exists..We have duly paid all the required Premiums etc ..I have no idea about Lasik Surgery..What can be done now? Plz Help..

i have decided to buy an agricultural land the seller says since rubber plants are there and it is mentioned in rtc any one can buy rubber plantation there is no restriction this property is in Karnataka where only agriculturist can buy an agricultural land please tell is there any such rule if yes from where can I get the gazette copy as the sub registrar says there is no such rule

My clints fathr name is mistacanly written wrongly in his all documents lick school living certy,marck shit of giverment, cast certyficate niw my clint is gating goverment job inted of his fathr but due to misteck of name of his father the goverment is not alowing him to join what can be dine to correct the name of my clints name in all certyficates

Mr. Joseph D'Souza, a manager of the boys' school run by a christian missionary applied to the govt. for permission to admit a girl student to the school as required under the State Education Rules. The State Govt. refused to give permission on the following grounds:
1. The school was purely a boys' school and not established as a co-ed school.
2. There is a purely girls high school nearby which is run by the muslim trust and if the permission is granted it will adversely affect the school run by the muslim trust.
Mr. D’Souza challenged the govt. order as violative of article 30 and article 14 of the Indian constitution, before the Hon'ble high court. The govt. took a stand that a govt. policy is not open for judicial review.
I have the following issues:
1. Whether the court was right in refusing permission to admit a girl student in pure boys' school?
2. Is there really a violation of article 30 and article 14 of the Indian constitution?
3. Can we judicially review a govt. policy?
